All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Rosalie Sommer sommer@suscom.net March 31, 2006, 5:31 pm Fawn township Written: April 4, 1839 Recorded: May 24, 1839 DEED 3P, page 417-418 GRANTOR (seller): Aquilla McDONALD and wife Mary GRANTEE (buyer): Conrad BADDERS and David BADDERS written: April 4, 1839 recorded: May 24, 1839 acres: 144 and 48 perches & some roads location: Fawn Township, by lands of Robert McDONALD, the late George BADDERS, John GODFRAY, John BROWN cost: $1400 history of deed: 21 Mar 1808 James McMILTEN and wife Jane to Jacob MARKEY & wife; Markey to Robert and Aquilla McDONALD as partners, then Robert McDONALD to Aquilla McDONALD ------- This Indenture made the fourth day of April eighteen hundred and thirty nine between of Aquilla McDONALD of the township of Hopewell and County of York and state of Pennsylvania, and Mary his wife of the one part and Conrad BADDERS and David BADDERS of the other part Witnesseth that the said of Aquilla McDONALD for added consideration of the sum of fourteen hundred dollars and to them in hand had by the said Conrad BADDERS and David BADDERS at and before the unsealing and delivering of these presents the receipt in payment whereof they do acknowledge and thereof acquit and forever discharge the said Conrad BADDERS and David BADDERS their heirs executors and administrators by their presents hath granted bargained sold aliened and enscoff released and confirmed unto the said Conrad BADDERS and David BADDERS and to their heirs and assigns all the following described tract of land situated in Fawn Township County and state aforesaid limited as follows. Beginning at a white oak thence North eighty degrees west twelve perches to stones thence North thirty five degrees west eighty perches to a red oak thence North forty seven degrees west seventy perches to a red oak, thence by land of Robert McDONALD North seven degrees west one hundred and one perches to a post thence by Land of formerly George BADDERS north eighty-six degrees and twenty four perches to a chestnut thence South fourteen degrees east fifty five perches to a black oak thence north forty eight degrees east thirty three perches to a black oak thence by land of John GODFRAY South 36 degrees west forty nine perches to a chestnut thence South eighty five degrees east fifty four perches to a chestnut thence South in the degrees West thirty perches to a heap of stones thence by land of John BROWN South fifty degrees West fifty nine perches to a black oak thence South fourteen degrees east thirty three perches to a black oak thence South seventeen degrees West and seventy perches to the place beginning containing one hundred forty four acres and forty eight perches and allowance of six percent for roads. And whereas entire James McMILTEN and Jane his wife did on the twenty first day of March by their deed duly executed on the aforesaid twenty first day of March eighteen hundred and eight by their deeds convey the above tract of land to Jacob MARKEY and to his heirs and assigns relation thereto might more fully approve And the said Jacob MARKEY and Elizabeth his wife by their indenture bearing date the twenty ninth day of March eighteen hundred and twenty three and for the consideration therein mentioned did sell and convey the above mentioned tract of land unto to Robert McDONALD and Aquilla McDONALD in partnership and whereas the said Robert McDONALD and Lidia his wife on the fourth day of April eighteen hundred and thirty nine and for the consideration therein mentioned and before acknowledged of this deed did assign and sell over all other right title claim and demand whatsoever in to or the above said tract of land unto the said Aquilla McDONALD and to his heirs and assigns forever wherein thereto being had would more fully and large appear Together with all and singular the buildings improvements rights liberties privilege hereditaments and appurtenances whatsoever there unto belonging and anywise appertaining and the revisions and remainders rents issues and profits thereof and also all the estate rights title interest property claim and demand whatsoever of them that the said Aquilla McDONALD and Mary his wife and law or equity or otherwise howsoever of in or out all of the same to have and to hold the said tract of land as above described with the hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said Conrad BADDERS and David BADDERS and their heirs and assigns to the only proper benefit use and behoof of the said Conrad BADDERS and David BADDERS and their heirs and assigns forever. And the said Aquilla McDONALD and Mary his wife and their heirs executors and administrators do hereby covenant promise grant and agree to and with the said Conrad BADDERS and David BADDERS and their heirs and assigns by their presence that they the said Aquilla McDONALD and Mary his wife their heirs the above mentioned and described premises hereby granted or mentioned or intended so to be with the appurtenances unto the said Conrad BADDERS and David BADDERS their heirs and assigns against the said of Aquilla McDONALD and Mary his wife and their heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the above set their hands and feels this day and year first above written. SIGNED: Aquilla McDONALD Mary (her X Mark) McDONALD Witness present at the sealing and delivering John MANIFOLD Levi BADDERS Received on the day of the days of the written indenture of and from the above named Conrad BADDERS and David BADDERS the sum of fourteen hundred dollars in full for the consideration money above-mentioned. ----- York County Ss Before me the subscriber one of the Justices of the Peace in and for the said County personally came the above named Aquilla McDONALD and Mary his wife and acknowledged the above indenture to be their act and deed and that the same might be recorded as such. She the said Mary being a full age and by me separate and apart from the said the husband examined and the contents of the said indenture being by me fully made know to her said private examination she declared that she voluntarily and of our own free will and accord and without any coercion or compulsion on the part of her said husband did sign seal and execute the same Testimony whereof, I have hereby set my hand and seal this fourth day of April eighteen hundred and thirty nine.
