"Whereas Peter Schriver late of Manchester Township, York County, Pennsylvania died on the -- day of January A.D. 1831 having in his lifetime made his last will and testament sealed and dated the 5th day of December A.D. 1830, which after his death to wit: on the 2nd day of February A.D. 1831, was duly admitted to probate by the Register of Wills of said County wherein and whereby he devised the tract of land which he called the John Hake tract to his widow Justina, as long as she remained his widow: And whereas the said testator made no devise of the said tract which he bought from John Hake after the termination of said estate devised as above set forth to his widow: And whereas after the death of the said Justina Schriver, widow of said Peter Schriver, deceased to wit on the 29th day of September A.D. 1874, proceedings in partition of said real estate were instituted in the Orphans Court of said County and after the necessary proceedings had said Court orders the said tract of land to be sold - by Henry A. Schriver administrator de bonis non with the will annexed of the said Peter Schriver deceased. And whereas after the death of the said Peter Schriver and before the institution or beginning of the said proceedings in partition of said real estate, his son Peter Schriver died leaving to survive him a widow, Nancy Schriver, one of the parties hereto and his son John Schriver also died leaving to survive him a widow Adaline Schriver one of the parties hereto. And whereas in pursuance of the said order of Court on the first day of April A.D. 1875 the said Henry A. Schriver, administrator d. b. n. c t. a. of the said Peter Schriver, deceased, sold and conveyed unto Jeremiah Schriver of said Township of Manchester, the said John Hake tract of land which in said last mentioned deed of conveyance is described as follows: Beginning at a point on the public road leading from York to Lewistown thence by lands formerly of said Peter Schriver, now of Frederick Shindel north fortyone and half degrees west thirty five and four tenths perches to stone thence north forty seven and half degrees west forty perches to stone, north forty two degrees and half east thirty and nine tenths perches to stone, thence by lands formerly of Peter Smith now _______ North thirty four and half degrees west ten and one tenth perches to a post now a Blk oak, thence by lands formerly of Andrew Shuler's [?] heirs, north forty eight and three quarter degrees west, one hundred and fifty two perches to a hickory, thence by lands formerly of Frederick Heak now of ______ north forty seven degrees west eleven and two tenths perches to a white oak on the bank of the Little Conewwago Creek thence of said creek south sixteen degrees west, twenty six perches thence south thirty five degrees west forty nine perches thence south eighty nine degrees west fourteen perches thence south thirty four degrees west sixteen perches to a post in said road thence along said road south seventy degrees east twenty three perches to a post, thence south seventy eight degrees east sixteen perches to a post, thence south sixty four degrees east seventeen perches to a post, thence south sixty two degrees east forty six perches to a post, thence south thirty five degrees east twenty five and six tenths perches to the place of Beginning Containing 64 acres and 78 ps. [See 1876 York County Atlas, p. 45, property labelled Mrs. Shriver Estate] It being the same tract of land which was conveyed to said Peter Schriver deceased by John Hake and wife, by their deed dated the 31st day of March A.D. 1830, reference being had thereto will more fully appear and whereas the said tract of land was conveyed as aforesaid for the consideration of Four thousand seven hundred and seven and 58/100 Dollars, the whole of which purchase money was paid in cash and no part or portion thereof was charged on said tract of land as the dower funds of the said Nancy Shriver, widow of the said Peter Schriver Jr deceased and Adaline Schriver widow of the said John Schriver deceased and the whole of the proceeds of said sale was accounted by the said Henry A. Schriver administrator as aforesaid and was distributed among and paid out to the heirs at law of the said Peter Schriver Sr. deceased. And whereas the said Jeremiah Schriver, the purchasor of said real estate is now also deceased, Daniel A. Schriver and William H. Schriver executors of the last will and testament have sold the real estate of which the said Jeremiah Schriver dies seized to Samuel Lehr who has declined to accept title thereto until the said Nancy Schriver and Adaline Schriver have released all right of dower which they have or may or can have in the said above described tract of land. Now therefore know all men by these Presents that we the said Nancy Schriver now Nancy Miles widow of the said Peter Schriver Jr deceased and Adaline Schriver now Adaline Baer widow of the said John Schriver deceased in order to enable the said Daniel A. Schriver and William H. Schriver [Nancy's son?] executors of the last will and testament of the said Jeremiah Schriver deceased to the said Samuel Lehr and in consideration of the sum of one Dollar to us paid at and before the ensealing and delivery hereof the receipt whereof is hereby acknowledged have remised released and quitclaimed and by these presents do remise release and quit claim unto the said Samuel Lehr his heirs and assigns all and all manner of dower and right and title of dower or other interest right or title whatsoever either at common law or under and by virtue of the Intestate Laws of the state of Pennsylvania which we the Nancy Schriver and Adaline Schriver now have or may might should or of right ought to have or claim of in, to or out of the above mentioned tract of land sold and conveyed as aforesaid by Henry A. Schriver administrator d. b. n. c. t. a. of the said Peter Schriver deceased to the said Jeremiah Schriver and every part and parcel thereof with the appurtenances and also all manners of action and actions, writs and writs of dower or other actions or proceedings either in the Orphans Court or other Court and right to make distress whatsoever so that neither we the said Nancy Schriver now Nancy Miles and Adaline Schriver now Adaline Bair nor any other person or persons whosoever for us or in our names stead or right any manner of Dower, writs of dower or actions right or title of dower or either at Common Law or under the Intestate laws of the state of Pennsylvania or other interest, claim or demand whatsoever of or in the said tract of land i.e. hereditaments and premises hereinbefore described or of or in any part or parcel thereof at any time hereafter shall or may have claim or prosecute against the said Samuel Lehr his heirs or assigns.
