"This Indenture, Made the thirtieth day of March A.D. one thousand eight hundred and Sixty four Between Samuel Small Jr, I. G. Eisenhart of the Borough of York, and John H. Houser of Sprin Garden Township all of the County of York, and State of Pennsylvania, Executor of the last Will & Testament of Ebenezer Richardson late of the Borough of York, dec'd of the first part, and Nancy B. Schriver of the said Borough of York of the Second part. Witnesseth That whereas the said Ebenezer Richardson by virtue of divers conveyances and assurances in the law duly had and executed became in his life time lawfully seized in his demense, as of fee(amongst other Real Estate) of and in certain messuage or tenement and part of certain half lot of piece of Ground Situate on the East Side of South Water Street in the Borough of York aforesaid, and being thereof seized, made his last will and Testament in writing bearing date the [long blank] day of [long blank] A.D. one thousand eight hundred and [long blank] wherein and whereby, amongst other things, He directed that the above mentioned premises should be sold by his Executors therein after named and of his said will appointed Samuel Small Jr., I. G. Eisenhart and John H. Houser Executors of Ebenezer Richardson dec'd did grant, bargain, and Sell the same to Nancy B. Schriver. Now this Indenture Witnesseth That the said Samuel Small, I. G. Eisenhart and John H. Houser Executors aforesaid for and in consideration of the Sum of Five hundred and twenty five dollars ($525) to them in hand paid by the said Nancy B. Schriver at and before the sealing and delivery of these presents the receipt and payment thereof is hereby acknowledged, Have granted, bargained, and sold and these presents by force and virtue of the power given in the Said recited last Will and Testament, do grant, bargain and sell unto the said Nancy B. Schriver all the following described part of a half lot or piece of Ground Situate on the east side of South Water Street in the Borough of York Aforesaid, Bounded and limited as follows to wit: on the South by lot of Joseph Fissel now Thomas McCanor on the east by a twelve feet wide alley, on the North property late of Jacob Glessner Esq. and on the west by Water Street aforesaid Containing in front on said Water street the full breadth of a half lot of Ground, and extending in length or depth Eastwardly one hundred twenty three feet, more or less, to the aforesaid twelve feet side alley. It being part and parcel of the Same half lot of Ground which Andrew Cremer and Penrose Robinson trustees of Lawrence Wolf by deed dated April first A.D. 1824 Conveyed to Francis McDermot, and the same which Patrick McAleer [?] Administrator of the Estate of the said Francis McDermot dec'd By virtue of an Order of the Orphans Court of York County aforesaid dated Number [November?] 3rd A.D. 1855, did sell and convey unto Patrick McGuigan, by deed dated January 23rd A.D. 1836, and which the said Patrick McAllear [?] and Rosanna his wife by Their Deed dated the first day of April A.D. 1841 did grant and convey unto John Sleeder and Which the Said John Sleeder and Elizabeth his wife by their deed dated the seventh day of February A.D. 1857 for the consideration therein mentioned did grant and confirm the same unto Frederick Greiman his heirs and assigns forever, and the same that Frederick Greiman and Mary his Wife by their Deed dated the first day of October A.D. 1859, for the consideration therein mentioned did grant and confirm the same unto Gibson Smith and Ebenezer Richardson, and to their heirs and assigns forever and the said Gibson Smith and Susan E. his wife by their assignment did grant, bargain and Sell and assign their undivided moiety or half part of the within described part of a half lot of Ground, bearing date the 16th day of November A.D.1860, for Such estate as was held and enjoyed by the Said Gibson Smith and Ebenezer Richardson, as in and by the said in part recited Deed and the proceedings had in the Orphans Court of York and the assignment of the Said Gibson Smith and Wife, to Said Ebenezer Richardson, will more fully and at large appear by reference to the Same. The last named Deed is Recorded in the Recorders Office at York in and for the County of York in Book D.D.D.D. page 75. &c. Together, with all and Singular the Buildings, Improvements, Ways, Woods, Waters, Water courses, Rights, liberties, Privileges, Hereditaments, and Appurtenances, Whatsoever, thereunto belonging, or in any wise appertaining, and the reversions and remainders, rents, issues, and profits thereof; and also all the estate, right, title, and interest, Whatsoever of the said Ebenezer or Richardson at and immediately before the time of his decease, in law, equity, or otherwise, howsoever, of, in, to, or out of the Same, to Have and the Hold the Said described part of a half lot of Ground and buildings with the appurtenances, unto the said Nancy B. Schriver her heirs and assigns, to the only proper use and behoof of her the said Nancy B. Schriver her heirs and assigns forever; by the same title, and to all intents and purposes, the same as held by the Said Ebenezer Richardson at and immediately before the time of his decease. And the said Samuel Small Jr, I.G. Eisenhart and John H. Houser for themselves their heirs, executors, and administrators, do covenant, promise, grant, and agree, to and with the said Nancy B. Schriver her heirs and assigns, by these presents, that they the Said Samuel Small Jr, I.G. Eisenhart, and John H. Houser have not heretofore done or committed or knowingly or willingly Suffered to be done or committed, any act, matter, or thing, whatsoever, whereby the premises hereby granted, or any part thereof, is, are, Shall, or may be impeached, charged, or encumbered in title, estate, or otherwise howsoever. In testimony Whereof, the Said Samuel Small jr, I. G. Eisenhart and John H. Houser have hereunto Set their hands and affixed their seals the day and Year above written." Samuel Small jr I. G.
