CUNNINGHAM Whereas Daniel WEAVER senior late of the borough of York deceased died intestate and was at his decease seized in fee of certain real estate, in the county of York, and whereas afterwards to wit: on the 5th day of August 1845 on the petition of Philip STAIR, inter-married with one of the daughters of said deceased, and in pursuance of an order of the orphans court of York County, and Inquisition was made and returned to the said Orphan's court, and duly confirmed by said court and by which said Inquisition the said real estate of said deceased was divided into 10 parts and evaluation made at each said parts: And whereas of towards, to wit, on the 16th day of September A.D. 1845, a rule was granted, by said Court on all the heirs of said Daniel WEAVER deceased, to appear on fourth day of November A.D. 1845 at the Orphans Court then to be holden and then there to accept or to refuse to accept, the said real estate, but the valuation thereon made on the said returned day of said to rule none of the heirs of said deceased appeared to take the said real estate or any part thereof at the valuation and there for the rule was granted by the said Orphan's Court upon the said heirs to show cause why the said real estate should not be sold in.... to which said rule of the said heirs did representatively signify in writing their assent that the same should be sold and did pray the said the court to award a sale thereof. And therefore an order to sell the same was by the said to court directed to the administrators of said deceased in and pursurance of said order a sale the said several parts of said the real estate were duly exposed at public sale to the highest and best bidder, and note of said real estate sold to Daniel WEAVER one of the heirs of said deceased and the other parts of said real estate remained unsold and were returned by the said administrators to the said court for the want of bidders and whereas the heirs of said Daniel WEAVER has since that time mutually agreed to said Daniel WEAVER purchaser as above consenting thereto: to treat the said sale as any unity and to divide the whole of said real estate amongst themselves a devaluation bear off and to make tend award deeds to any other respectively which shall vest in the heir accepting any part of said real estate the title of all the other heirs in and to such part. And whereas by said indenture agreement that part of the said the real estate designated as No. 3 is to be taken by Jeremiah WEAVER and Stephen W. CUNNINGHAM and Eliza his wife two of the said heirs now therefore known all men by these presents, that we Philip STAIR and Lydia his wife, Jacob CREMER and Catharine his wife, Daniel WEAVER and Sarah his wife and Samuel WEAVER as well in consideration of the premises and decd this day made to us respectively by the said Jeremiah Weaver and Stephen W. CUNNINGHAM and Eliza his wife as of as of six acts to us respectively paid by the said Jeremiah WEAVER and Stephen W. CUNNINGHAM and Eliza his wife to do ... grant bargain and sell unto the said that Jeremiah WEAVER and Stephen W. CUNNINGHAM and wife as tenants in common all the following property to wit: No e. A tract of lands situated in York Township in the county of York containing one hundred and twenty acres more or less adjoining lands now or formerly of John NEUTIG, Jacob WEISER, Widow HEISEY and others which said Inquisition value and appraised at the sum of $3600 which said property the said Daniel WEAVER senior did seized and see for sick estate and the said Daniel WEAVER senior at the time of his death held the same To have an to hold the said of glove described premises and appurtenances unto the said Jeremiah WEAVER and Stephen W. CUNNINGHAM and Eliza his wife as tenants in common their heirs and assigns forever.
