Hershey to him. The deed, alleged to have been lost, is for a valuable brick dwelling house on the left side of Abbottstown street, Hanover, on the corner of an alley, a short distance west of Fulton street. The lost deed is alleged to have been given to John Hershey by his brother, George Hershey, in 1871. It was clearly shown that John Hershey has had possession and has claimed title to the property ever since 1871. George Hershey died a short time after the date of the alleged deed, and John Hershey claims that some years ago the deed was lost or mislaid. A witness whom, it is alleged saw the deed, being unable to attend court on account of illness, the court directed that his testimony be taken before a notary public and handed to the court. Heirs of George Hershey, nephews and nieces, are contesting the proceedings, claiming that they are entitled to their share of the property as heirs of George Hershey. John J. Bollinger, Esq., appeared for John Hershey; J. E. Weaver, Esq., for the contestants. The court will render a decision after the notes of testimony have been filed.
