The petition of Levi Badders Eldest son and heir at law of George Badders deceased, Respectfully Represents. That the said George Badders died Intestate, leaving no widow, but lawful issue to wit, Levi Badders the eldest son Aforesaid, James Badders, William Badders, Elizabeth intermarried with Ebenezer Edgar and Nancy Badders and seized in his demise as of fee of a plantation and tract of land situate in Fawn Township, York County containing two hundred and twenty five acres more or less (with the buildings and appurtenances) of warranted land except sixty four acres which he held by application, adjoining lands of Robert McDonald, John Grove, John Godfrey, Jacob Markey and others which said children the said estate descended and who hold the same undivided. Your petitioner therefore prays your honors to avoid an inquest to make partition of said real Estate to and amongst the said parties or amoungst so many of the children as the same will conveniently accommodate but if the same will not admit of any partition or division without prejudice to or spoiling the whole then to appraise the same undivided. Whereupon it is considered by the Court and ordered that the Sheriff of the County of York in his proper person with twelve good and lawful men of his Bailiwick in the presence of all the parties who shall muse to attend or the Guardians of such of them as are minors they respectively having due and legal notice Whereof Do hold and Inquest on the said premises and make partition thereof with the appurtenances To and amongst the children and representatives of said Intestate if the same will admit of such partition without prejudice to or spoiling the whole by meters and bounds and Value and appraise each part separately but if they find the same cannot be so divided then that they well and truly enquire whether the said premises will conveniently accommodate more than one of the said children of said Interstate and if they so find then What they well and truly partition the same into so many part as the same will Bear or accommodate by meters and bounds and Value and Appraises each purpart. But if the said Inquest shall find that the premises will not admit of partition of Division at all then that they well and truly Value and appraise the whole together and undivided according to Law. And that the said Sheriff Do make Return of said Inquisition (annexed to this order) as well under his own hand and seal as the hands and seals of said Inquest to the next Orphans Court after the same is held. ----------------------- 1822 MAY 1 VALUATION OF PROPERTY OF GEORGE BADDERS BY 12 MEN Inquisition Indented and taken on the lands herin after mentioned The first day of May in the year one thousand eight hundred and twenty two before Thomas Jameson Esquire high Sheriff of the County of York by virtue of a Writ of partition and valuation to him directed and to this Inquisition annexed on the Oaths and affirmation of Alexander Wallace, James Edie, Bartholemew Zellars. Ashable Steal Jorden, John Hoover, John Cleauch (?), John Grove, Joseph Leib, William Ligget, John Bortner, Andrew Purkepile, Thomas Brooks. Respectively taken twelve honest and lawfull men of his Bailiwick who on their Oaths and affirmations aforesaid respectively do say that they went to the messuage lands, and estates of which the said George Badders, the intested in Writ hereunto annexed named Died Seized and find that the premises aforesaid will not admit of partition between all the heirs of said deceased without prejudice to and spoiling the whole and the inquest aforesaid. On the oath and affirmations aforesaid do find that the premises will accommodate One of the Heirs of the said deceased and the Inquest aforesaid on their Oaths and Affirmations afforsaid Do Value and Appraise the same undevided (spelled this way at the sum of Twenty Four hundred and Seven Dollars and Fifty Cents. In Testimony wherof the said Sheriff and the Inquest Aforesaid have hereunto set out hands and Seals the day and year aforsaid Thomas Jamison Sheriff SIGNED original signatures of all of the above 12 listed men. ----------------------- 1822 NOVEMBER 12 TO SELL PROPERTY OF GEORGE BADDERS York County Archives York County, George Badders file found 10 August 2001 by Rosalie Sommer a scralled note on the back of another document read Rule on the heirs of George Badders decd to the Real Estate of the appraisement or shew cause why the same should not be sold. 12 November 1822, granted ----------------------- 1822 DEC 17 GEORGE BADDERS OF FAWN TWP YORK COUNTY PA REAL ESTATE TO BE SOLD [Found in York county Court House, PA Rosalie Sommer 1978[ Orphans Court Docket N, 495 17 December 1822 Whereas the Real Estate of George Badders, late of Fawn Township, deceased, who died intestate, was lately valued appraised by an Inquest Summoned for the purpose and confirmed by this Court. And whereas a Rule was granted on all the Heirs and persons interested in said Estate required them to be and appear at the Court and accept on refuse to accept of said Estate at the Valuation and in case of their refusal to accept the same to shew cause why the same should not be sold, which said Rule was proven to have been served on all the Heirs residing in the County of York & public for four succesive weeks in the York Recorder a public newspaper published in the Borough shew cause why the same should not be sold The Court on Motion Orders and direct that the Administrators of said Intestate Do (after first giving due & legal notice thereof) Expose to public Sale or outcry the said premises, Vis, a certain Messauge and plantation containing Two hundred and twenty five acres, more or less. Situate in Fawn Township adjoining lands of Robert McDonald, John Grove, John Godfrey, Jacob Marky, and others. And that the sale be held on the second Monday in January next that the terms of sale shall be one half the purchase money to be paid on the first day of April next and the residue in six annual payments without Interest that they sell the same for the highest and best price that can be had for the same, said Administrators have power to adjourn said sale if necessary, and make Report of their proceedings to the next Orphans Court After the Sale is held. ----------------------- 1822 DECEMBER 17 ORDER TO MAKE PARTITION OR VALUATION OF THE REAL ESTATE OF GEORGE BADDERS Original document dated 17 Dec 1822 found at York County Archive, York PA original of the 17 Dec 1822 found at York County Archives [notes Rosalie Sommer 10 Aug 2001 with additional papers attached] Order to Sell the Real Estate of George Badders, late of Fawn Township deceased filed Feb 18th 1823 [original document was same as above with this additional document attached to the original signed by Levi Badders] To the Hon, The Judges of the Orphans Court of York County The administrator of the estate of George Badders deceased make report that in obeyance to the order within contained be enforced the plantation and tract of land within described containing two hundred and twenty five acres and one hundred and twelve perches at public sale on the premises, on the 12th, second Monday of January 1823 - after having given due and legal notices of the time and place of sale and the same when then and there sold by public outcry to William Badders he being the highest and best bidder for the same at and for the sum of nine dollars and one cent per acre being equal to two thousand thirty three dollars fifty three cents 0 for the whole which is submitted to the court SIGNED Levi Badders (original signature) ----------------------- January 13, 1823 Agreeable to the order the real estate of George Badders was stuck of to William Badder (no s on handwritten record) of Baltimore County at nine dollars and one cent per acre signed Wm Badders (original signature, signed with an s on Badders and also as Wm.) ----------------------- 1823 MAY 13 GEORGE BADDERS OF FAWN TWP YORK COUNTY PA PROPERTY SOLD Found in York county Court House, PA Rosalie Sommer 1978 Orphans Court Docket O, 30 13th May 1823 Levi Badders, Administrator of the Estate of George Badders, late of Fawn Township deceased, produced a further account as settled with the Register of this County. Balance in his hands Nineteen Hundred and fifty five dollars thirty five and a half cents, which account the Court do hereby Confirm. ----------------------- 1823 DEC 16 MONEY PAID TO CREDITORS & HEIRS Found in York county Court House, PA Rosalie Sommer 1978 Orphans Court Docket O, 183 16th Dec 1823 -- Levi Badders, John Ebaugh and John Bortner respectively bound unto the Commonwealth of Pennsylvania each in the Sum of Four thousand dollars, lawful money s/p Pennsylvania, To be levied of their Goods and Chattels, lands and tenements respectively upon this condition the Levi Badders administrator of the estate of George Badders deceased will pay over for the use of the Creditors and Heirs of said deceased, when legally called on the amount which the Real Estate of said deceased sold for, which was sold in pursuance of an order of the Orphans Court of York county.
