All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/york/ ________________________________________________ Michael Carl et al & Geo Carl et al Know All men by these presents that We Michael Carl and Casper Rinacker both of York County in the State of Pennsylvania are held and firmly Bound unto George Carl, Martin Carl, and Annmary Carl and John Kraft all of the County and State aforesaid in the just and full sum of Ten thousand pounds Lawfull money of Pennsylvania aforesaid to be paid to the said Martin Carl, George Carl AnnMary Carl and John Kraft or to their Certain Attorney Heirs Executors Administrators or Assigns for they witch payment well and truely to be made and don, We binde our selves Jointly and Severally our and each of our Heirs Executors and Administrators firmly by these presents Sealed with our Seals dated the Eight of August in the year of our Lord one thousand seven hundred and Eighty The Condition of the above obligation is Such that if the above bounden Michael Carl and Casper Rinacker and each there theirs Executors and Administrators respectively do and shall for his and there parts and behalf in and by all things will and truly stand to obay, abide, observe Perform fulfill and keep the Award Arbetrament Order Judgment final End and determination of Nicholas Bettinger, Christian Millhime, Simon Clar, Michael Webright, Henry Slagle and Patrick Brubacker or any five of them Arbetrators indiferently Named Elected and Chosen as well on the part and behalf of the above Bounden Michael Carl and Casper Rinacker as on the part and behalf of the above named George Carl, Martin Carl, AnnMary Carl and John Kraft to award arbetrate order Judge and determine of for upon and Concerning Certain Claim which he the said Michael Carl and Casper Rinacker have to the Real and personal Estate of Michael Carl the Elder deceased and of for upon and Concerning all and all and all matter of actions and Causes of Actions Suits in Law or Equity Bills Bonds Specialties Sum or Sums of money Quarrels Contentions Debates differences and Demands whatsoever now had made moving depending Arising Acrewing Growing or being between the said parties for or by reason of any other Matter Cause or thing whatsoever from the Begining of the World untill the day of the date of above written so as the said Award Arbetrament Order Judgement Finel end and detirmination of the Arbetrators or any five of them of and upon the premises or any part hereof be made and given up in writting under there Hand and Seals ready to be delivered to said parties on or before the first day of September next Ensuing the date hereof then this obligation to be void otherwise to be and remain in full force and virtue Michael Carli Sealed and delivered in the presents of Us Casper Rinnecker Nicholas Bucher Johannes Bucher York County to wit Be it Remembered That Nicholas Beecher one of the Subscribing Witness to the foregoing Instrument of Writing Appeared in open Court at a Court of Common pleas held at York for said County on the third day of January 1793 and on his Solemn Affirmation taken according to Law says that he saw Michael Carl and Casper Rinecker Sign Seal and Deliver and Acknowledge as their Act and Deed the foregoing Instrument of Writing and that he saw John Beecher the other Witness Subscribe his name thereto In Testimony wherof I have hereunto set my Hand and Affixed the Seal of said Court the day & year afors~ H Miller Prot y A true Copy taken from & compared with the Original at York the 1st day of March AD 1793 Michl Carl et al JBarnitz Recorder AWARD TO ALL to whome these presents shall Come We Nicholas Bettinger, Christian Millhime, Michael Webright, Simon Clar, Patrick Brubacker and Henry Slagle, all of the County of York & State of Pennsylvania do Send Greeting Whereas there are sundry disputes and differences depending between Michael Carl and Casper Rinacker of the County and State aforesaid of the one part, and Annmary Carl Widow and Relict of Michael Karl of the County and State aforesaid deceased, George Karl, Martin Karl and John Kraft all of the County and State aforesaid of the other part And Whereas for puting an end to said differences and disputes They the said parties by their Several Bonds and Obligations bearing date the Eight day of this Instant last past, are reciprocally become Bound to each other in the pennal Sum of Ten thousand pounds to stand to obay abide, perform and keep the Award final end and determination of Us the said Nicholas Bittinger, Christian Milhime, Michael Webright, Simon Clar, Patrick Brubacker and Henry Slagle, so as the said Award and Determination be made in Writting and ready to be delivered to said parties in difference, on or before the first day of September next as by the said Obligations and Conditions may appear. Now know yea that we the said Arbitrators whose names are hereunto Subscribed and Seals Affixed, taking upon us the Burden of the said Award and having fully Examined and duly Considered the proofs and Allegations of all said parties. Do make and publish this our Award, Between the said parties in manner and form following that is to say, First We do Award and Order that all Actions Suits and Quarrel between said parties to the day of the date hereof do Cease and be no further Prosecuted And We do Award Order & direct that the above named Martin Karl have the plantation and Tract of Land Called the Lower place, Containing Two hundred Acres and the Allowance as said deceaseds Will directs, And that all the other above named parties do Release by Sufficient Instrument of Writting all there Shears of said Land of Premises unto him the said Martin Karl his Heirs & assigns forever, on or before the first day of October next ensuing And We do Award Order and direct that John Kraft aforesaid have the four Acres of land which he agreed for and that all the other above named parties do Release by a Sufficient Instrument of Writting all there Shears of said four Acres of Land unto him the said John Kraft his Heirs and Assigns forever, On or before the first day of October next And We do also Award Order and direct that the aforesaid Michael Karl have all the Remainder of said deceaseds Land Caled the uper place, Containing 334 Acres be the same more or less for the sum of Fourteen hundred pounds Good and Lawfull money in Gold or Silver and to be paid in sundary payments that is to say the Sum of Two hundred & fifty pounds in Gould or Silver on the fifteenth day of April next Ensuing and then yearly the Sum of One hundred pounds like money That he the said Michael Karl do retain the one sixth part of the aforesaid Yearly payments for his Own part of said deceaseds real Estate, and That he pay all the Remainder of the said Yearly Payments as they become first due to George Karl aforesaid his Heirs or Assigns untill he the said George shall have Received the one Eaquill half part of the aforesaid Sum of Fourteen hundred pounds for his part of said deceaseds Real Estate That he the said Michael Karl do pay all the Remainder of said payments Except the last payment of fifty pounds to said John Kraft his Heirs and Assigns in full for his Shear of said deceaseds Real Estate in right of his Wife Catherana And that he the said Michael Karl do also pay the said fifty pounds in Gould or Silver out of the last payment being the Residue unto Casper Rinacker his Heirs and Assigns for his Shear of the said Estate in right of his Wife Ann Mary. And We do Award Order and direct that Anmary Karl, Widow of said deceased have all the Legasies as devised to her by the last Will and Testament of said deceased, And that Michael Karl and Martin Karl aforesaid do Give unto her the said Widow a proper Instrument of Writting in which they and their Heirs shall be Bound to pay and perform the payments and Maintainence yearly during her natural life, which George Karl and said Martin Karl were directed to perform and keep toward their Mother in and by the last Will and Testament of said deceased and moreover allow her place during her Natural life. And We do also Award Order and direct that said AnnMary Karl, George Karl, Martin Karl, Casper Rinacker and AnnMary his Wife , John Kraft and Catharana his Wife for themselves and there Heirs. On his the said Michael Karl Giving Bonds for the Several payments aforesaid and Maintainance aforesaid shall ? by and Severally Releas by good and Sufficiant Instruments of Writting in due for of Law, all there Shears and purparts of the before mentioned uper place Containing three Hundred and thirty four Acres of Land be the same more or less with the Appurtenances and premises unto him the aforesaid Michael Karl his Heirs and Assigns forever on or before the said first day of October next And We do Award that the aforesaid Michael Karl and Martin Karl or there Heirs do pay Eaquilly between them unto Casper Rinacker or his Heirs after the death of said Widow, the Sum of twentyfieve pounds in Gould or Silver as said deceaseds Will directs. And We do Award that the Negro Boy named Sam to said George Karl his Heirs and Assigns, and the Negro Woman named Susey to John Kraft his Heirs and Assigns after the death of said Widow. We do Award that said Michael Karl, George Karl, and Martin Karl do devide said deceaseds Apperril Eaquilly between them, and that they the said Michael, George and Martin do hold the Smiths Tools Jointly between them at the appraisment, and do Account for the same And We do Award that Martin Karl do received the one half of said deceaseds Cows, Horses, Sheep and Hoggs, and Impliments of Hubandrey and the one third part of all said deceaseds Houshold Goods as his Will directs, All the rest of the said deceaseds personal Estate after paying all Just Debts against said Estate, to be eaquilly devided to and between the said AnMary Karl, Michael Karl, George Karl, Casper Rinacker, Martin Karl and John Kraft and there Heirs. And Lastly that the Expence of this Award be paid out of said deceaseds Estate In Witness whereof We have hereunto set our Hands and Seals the 24th of August 1780. the words (death of widow) Patrick Brubacker seal Nichs Biettinger seal were first interlined in the Simon Clear seal Christian Mullheim seal 14th line of the page Henry Slagle seal Michael Webright seal York County Be it remembered that Henry Slagle Esquire appeared in open Court court seal at a Court of Common pleas Held at York for said County on the third day January 1793 and on his Solemn Oath taken according to Law says that the arbitrators whose names are Subscribed to the foregoing Award Sign the same, and that the parties interested at that time Acknowledged their Satisfaction and Approbation of the same.
