I Frederick Hyre of Newbury Township in the County of York and State of Pennsylvania Yeoman, being weak in body but of perfect Mind and Memory, thanks be to God therefore, and calling to Mind the Mortality of the body, and knowing that it is appointed for all men once to die I do make and ordain this my last Will and Testament, and that is to say, first of all I recommend my Soul unto God that gave it and my body to be buried in a Christian and decent manner at the discretion of my Executors, and as touching such Worldly Estate wherewith it pleased God to bless me in this life I give, devise and dispose of in the following manner and form. Item, I order first of all that the doctors bill and my funeral Expenses be paid, and next that all my just debts be discharged. Imprimis, I give and bequeath unto my son Charles Hyre a certain piece or parcel of land situate in Newbury Township aforesaid, adjoining lands of Gasper Pruner land formerly George Sniders, Jacob Steirs, Philip Baker, [blank] Wigels, and other lands of mine, containing forty seven acres and one Hundred and fourteen perches & the usual allowance for roads &ca. and likewise ten pounds of Money which said Charles hath had of me. Item I give and bequeath unto my Son Jacob Hyre, a certain piece or parcel of land, adjoining the other land above mentioned and said [blank] Wigels, John Breneman, Frederick Zerger, Frederick Stine, & Mathias Zerger, Containing ninety three acres, and fourteen perches and the usual allowance for roads &ca. Item I give and bequeath unto my daughter Elizabeth wife of Jacob Todesman forty two pounds, seventeen shillings and six pence which she hath had, and a further sum of one hundred and fifty pounds in lawful money, of Pennsylvania, to be paid and secured to be paid in manner following (to Wit) the said Charles Hyre, & Jacob Hyre are to give their obligations for the payment thereof to the said Elizabeth Todesman, and her heirs of her body, each one their equal proportion that is to say, each one is to give their obligations for seventy five pounds, to be paid yearly and every year (after one Year is elapsed) after my decease, the Sum of twenty five pounds each one of them paying an equal share thereof unto the said Elizabeth or to her attorney heirs, Executors, or Administrators for the use of her or her heirs. Item I will and allow that my son Jacob shall keep my daughter Magdalene and provide for her for her Services which she shall do for him until she arrives to the age of Eighteen Years, and then he the said Jacob or his heirs, Executors or Administrators shall give and deliver unto her the said Magdalene, one Cow, one bed and furniture and one spinning Wheel and the sum of twelve pounds, ten Shillings, and my son Charles shall pay unto her the said Magdalene the like sum of twelve pounds, ten Shillings each of them to pay it in lawful money of Pennsylvania. Notwithstanding if she the said Magdalene should not live until she arrive to the age of Eighteen Years the said Goods, Chattels, and Sums of Money herein willed to her are not to go out of my sons Estates, but to remain to be their own, and also if she should die with Issue (if paid to her) it shall return back again to them. And my Will is that all my personal Estate shall be sold at public Sale and that my sons Charles & Jacob each one to have share and share alike of the moneys, arising therefrom, and each one to pay his equal parts of my debts (except two kettles one Copper and the other brass and one corner cupboard is to be and remain with my son Jacob as his own property and they are each to have an equal share of my outstanding debts. Item I do likewise Constitute make and ordain these my well beloved Son Jacob Hyre Yeoman to be my only and my absolute and sole Executor of this my last Will and Testament, and I do hereby utterly disallow, revoke and disannull all and every other former Testaments Wills, Legacies, and Executors by me in any wise before this time named Willed and Bequeathed, ratifying and confirming this and no other to be my Last Will and Testament. In Witness whereof I have hereunto set my hand and Seal the twenty second day of January in the Year of Our Lord, anno domini, One thousand Seven hundred and ninety six. his Frederick I Hyre mark Signed, Sealed, published, pronounced and declared by the said Frederick Hyre as his last Will and Testament in the presence of us the subscribers. Mattsuir [?] Zorger, Samuel Miller York County ss, Before me Jacob Barnitz Esq. Register for the probate of Wills & granting letters of Administration in & for the County of York in the State of Pennsylvania, personally came Matthias Zorger and Samuel Miller the two subscribing Witnesses to the foregoing Instrument of Writing, and the said Matthias Zorger on his solemn Oath, and the said Samuel Miller on his solemn Affirmation he conscientiously scrupling the taking of an Oath, do severally say that they were personally present and saw and heard the above named Frederick Hyre, make his mark unto and seal and publish the foregoing Instrument of Writing, as and for his last Will and Testament, and that at the time of the doing thereof he the said Frederick Hyre was of a sound and disposing Mind, Memory and understanding to the best of their Knowledge and belief, and that they subscribed their names thereto as Witnesses in the presence of the said Testator, and also in the presence of each other at the same time. A true Copy taken from & Compared with the Original. J. Barnitz Regr. Memorandum That letters Testamentary in common form were granted unto Jacob Hyre of the Estate of Frederick Hyre. Inventory to be Exhibited into the Registers Office at York on or before the Twelfth day of May next ensuing. And an account or reckoning in a Year or when legally thereunto required.
