Will of Josiah KERR 1783 In the Name of God Amen, I Josiah KERR Senr of Mount Pleasant Township in the County of York and State of Pennsylvania being sick and weak of body but of sound mind and memory calling to mind the morality of my body and knowing that it is appointed for all men once to die, do this twenty third day of December in the Year of our Lord one thousand seven hundred and eighty three, make and publish this my last Will and Testament in manner and form following. Principally and first of all I commit my soul to the Almighty God who gave it to me and my body to the earth after my decease to be buried in a Christian and decent manner at the discretion of my Executors and as touching and concerning such worldly goods as God and in His kind Providence has been pleased to bless me with I give, grant, bequeath and dispose of in the following manner (that is to say) Impremis and first of all I Order, Will and Allow all of my Just Debts and funerall charges to be well and truly paid and for the purpose aforesaid I order, will and allow one hundred and twenty acres of land with the usual allowance to be sold by my Executors if not sold before my decease on the westward side of the whole tract to include the improvements where my son Josiah formerly lived hereby giving and authorizing my Executors with full power to grant, bargain, sell and convey the said land above mentioned and the money arising therefrom to be taken to pay off all debts which were contracted by my son Josiah KERR for which either I or my son William KERR became bound or both of jointly. Item 2 I grant and bequeath unto my Dearly and well Beloved Wife Mary KERR the horse that she commonly rides with her saddle and bridle and one cow, any one she may make choice of. Both cow and horse to be kept and maintained on my real estate or plantation as also the mare, colt which she herself purchased as also a bed and bedbloath (?) and bedstead as also free liberty of house room and bed room in the (?) room and liberty of the kitchen with one chest of drawers, one table, two chairs, one third of the kitchen furniture, one half of the dresser furniture as also twelve bushels of wheat, twelve bushels of Indian corn, one hundred weight of beef or pork and one half acre of flax ground carefully, plowed, sowed and put into be continued or given and allowed out of any from my real estate for and during her natural life as also I give and bequeath unto my Dearly Beloved the time of a Servant Girl (viz) Susannah Carty yet nevertheless my wife giving and allowing the said girl the freedom contracted for except one heffer which shall be taken from any estate as also I further give and bequeath unto my wife aforesaid the sum of five pounds currency to be paid her out of and from my real estate yearly and every year during the term above mentioned as also five pounds of good wool yearly as aforesaid the whole taken together being in full of her dower and share~ Item 3 I give and bequeath unto my well Beloved Daughter Susannah COULTER the sum of ten pounds currency to be paid her in one year after my decease. Item 4 I give and bequeath unto my former son in law William FULTON the sum of five shillings, sterling if demanded. Item 5 I give and bequeath unto my well Beloved Son Josiah KERR the sum of five shillings, sterling if demanded. Item 6 I give and bequeath unto my well Beloved Grandson Josiah KERR, son of Alexander KERR the sum of sixty pounds currency. Fifteen pounds thereof to be paid him as soon as he arrives to the age of twenty one years. Fifteen pounds yearly and every year until the said sum be paid. Also the three last payments to bear lawful interest from his arrival to the age until paid. Item 7 I give and bequeath unto my Beloved Grand Son John KERR son of Alexander KERR as aforesaid the sum of five pounds currency to be paid him when he arrives at the age of twenty one years. Item 8 I give and bequeath to my well Beloved Grand children Jannet, Mary, Susannah, Martha and John COULTER the sum of three pounds each to be paid them when they shall arrive at age in law. Item 9 I also give, grant, and bequeath unto my well Beloved Son William KERR all and singular the residue of all my Estate, Real and Personal, Lands, Goods, Chattels to be holden of him, his heirs and assigns forever subject nevertheless to al and singular the Legacies, Bequeaths, Debts, Privileges, Yearly Articles of Support herein mentioned or intended so to be and Lastlye I Constitute and appoint my well Beloved Son William KERR and my Trusty Friend James MCKINNEY of Mount Joy Township my whole and sole Executors of this my last Will and Testament in Trust to Execute the same according to (?) intent and meaning thereof and also I do constitute and appoint my friend David DUNWODY Senr Overseer of this my Last Will and testament to take care and see that the same be Duly Executed and performed agreeable to the Tennor? and Intention there of hereby ? and confirming this and no other as my last will and testament in testimony whereof I the said Josiah KERR Senr. have hereunto set my hand and seal the day and year above written~~~~ Signed Sealed published Josiah Kerr Granted by Archibald MCCLEAN, Equ.
