Orr orr@hawaii.com September 21, 2007, 3:30 pm Source: York County, Pennsylvania Written: April 20, 1781 Recorded: October 22, 1782 In the Name of God Amen I John McFerren of Cumberland Township County of York and State of Pennsylvania Yeoman being weakly of body but of perfect mind and memory – calling to mind the mortality of the body that it is appointed for all men and do die do make consulate and appoint this my last Will and Testament in manner following. First I allow all my debts and funeral charges to be paid the remainder of my Estate to be disposed of in manner following viz first I leave and bequeath to loving wife, Martha McFerran all my personal estate except one cow and one bay colt I leave to my son William and John McFerran five shillings sterling or the value thereof in Pennsylvania currency each. I allow my real estate to be sold within one year after my death at the direction of my Executors and the whole sum after payment of all debts to be equally divided into eleven parts among or between my wife and children Samuel, Andrew, John McFerran, my son Williams son my daughter’s Elizabeth, Mary, Jane, Agnes, Susanna, Martha and Annie each to receive an equal part as it shall come due by the articles of sale. I also constitute and appoint my loving brother Samuel McFerran and my trusty and well beloved friend John Flemming Executors of this my last Will and Testament. And I do revoke all other Wills or Instruments of writing that may hereafter be drawn in ignorance hereafter. In testimony whereof I have hereunto set my hand and seal this Twentieth(?) day of April one thousand seven hundred and eighty one. /s/ John McFerran Signed, sealed and declared In presence of David Wilson and Henry Buchannan York County, Before me Archibald McClean Esquire Register for the Probate of Wills and granting letters of Administration in and for the County of York in the State of Pennsylvania personally came David Wilson one of the subscribing witnesses to the within and before written instrument of writing and on his solemn oath in the Common form of Law doth testify and say that he was personally present and saw and heard the within named John McFerran sign his name unto and seal and publish the within written instrument of writing as and for his last Will and Testament and that at the time of the doing thereof he the said John McFerran was of sound and disposing mind memory and understanding the best of his knowledge and belief and that he did subscribe his name thereto as a witness in the presence of the said testator and at his request and further that he did also see Henry Buchannan the other witness subscribe his name thereto as a witness at the same time. /s/ David Wilson Sworn and subscribed before me at York the 22 Day of Oct. 1782 Arch. McClean, Register York County, Before me Archibald McClean Esquire Register for the Probate of Wills and granting letters of Administration in and for the County of York in the State of Pennsylvania personally came Henry Buchannan the other subscribing witness to the within instrument of writing and on his solemn oath in the Common form of Law doth testify and say that he was personally present and saw and heard the within named John McFerran sign his name unto and seal and publish the within written instrument of writing as and for his last Will and Testament and that at the time of the doing thereof he the said John McFerran was of sound and disposing mind memory and understanding the best of his knowledge and belief and that he did subscribe his name thereto as a witness in the presence of the said testator and at his request and further that he did also see David Wilson the other witness subscribe his name thereto as a witness at the same time. /s/ Henry Buchannan Sworn and subscribed before me at York the 3 Day of March 1783 Arch. McClean, Register Memorandum That Letters Testamentary in Common Form was granted unto Samuel McFerran of the Estate of John McFerran late of York County deceased, inventory to be --?— into the Register’s Office at York on or before the Seventeenth Day of October 1784 and an account or reckoning on or before the seventeenth Day of September which will be in the year of our Lord one thousand seven hundred and eighty five.
