I have tried to copy spelling as I saw/read it-- In the name of God amen I Ludwig Miller of Germany township in the county of York and State of Pennsylvania being weak in body and advanced in age but of sound and disposing mind memory and understanding blessed be God, and considering the many accidents that attend and will at length end this mortal life DO make and declare this my last will and testament, in manner and form following. Imprimis I do will order and direct that all my just debts and funeral charges be paid of and dischargd as soon as convenient after my decease by my Executors herein after named Item I do give and bequeth unto my Dearly beloved Wife Ann Barbara the Bead and Bead Cloaths that we _____(usually?) sleep in her choice of two cows and two sheep and the one full third part of all my personall estate Item I do give and devise unto my son Nicholas Miller all that plantation and tract of land that he now lives on in Mountjoy Township containing one hundred and sixty nine acres of land be the same more or less with the appurtanances and premisses to hold to him the said Nicholas Miller and to his heirs and assigns for ever Item I do give and devise to my son Ludwig MIller and my daughter Ann Maria Miller all that plantation and tract of land that I now live on containing three hundred and fifty acres of land be the same more or less in Germany Township aforesaid with the appurtanancees and premises to hold to them the said Ludwig MIller and Ann Maria Miller Jointly and severally and eqquilly and to there heirs and assigns for ever. Item I do give and devise unto my three children Nicholas Miller Ludwig MIller and Ann Maria Miller all that plantation and other tract of land adjoining Henry Moyer and Thomas Larimer in Mount Joy Township aforesaid containing one hundred and sixty acres of land be the same more or less it being the eqauil half part of a larger tract of land, with the appurtanances and premises to hold to them the said Nicholas MIller Ludwig mIller and Ann Maria Miller, jointly and Severally and Eaquilly and to there heirs and assigns for ever Item I do next page Item I do give and bequeath unto my oldest son Nicholas Miler for his birth right the sum of fifty pounds good and lawfull money of gould or silver to be paid him out of my personal estate, Item I do give and bequeath unto Henry Moyer and his wife Barbara one other of my daughters, the sum of five shillings good and lawfull money which with what they have already received is to be in full of his or there shears of my Estate both real and personal Item I do give and bequeath all the residue of my Personal estate to be eqauilly devided to and between Nicholas Miller Ludwig Miller and Ann Maria Miller three of my children shear and shear alike Item I do give and bequeath unto my Loving wife Ann Barbara, free and full possession and previledge of the dwelling hous that I now live in with the seller and stable room for two cows and three sheep with sufficient Hay and pasture a garding the one third part of all fruit trees and half acre of ground for potatos and necessary fire wood al from my son Ludwig Miller and my daughter Ann Maria out of the plantation that I now live on for and during the ____of her natural life Item I do give and bequeath to my said loving wife Ann Barbara twenty bushels of wheat twenty bushels of rey? one hundred pounds of pork fifty pounds of beef and three quarters of an acre of good flax ground put in in good order to be given and delivered to her yearly and every year during her natural life equally by my three children Nicholas Miller Ludwig MIller and Ann Maria Miller or there heirs Item I do hereby also order and direct that my three children Nicholas Miller Ludwig MIller and Ann Mary Miller do expose to sail the hous and lott which I have in Taney Town in the Stait of Maryland for the best price that can be had for the same hereby impowering them the said Nicholas MIller Ludwig MIller and Ann Mary Miller or such of them as shall then be alive to convay the said hous and lott to the Purchaser or purchasers his or there heirs and assigns for ever, the one third part of the money arrizing from the sail thereof to be paid to my wife the said Ann Barbara Miller and the remiander to be eqauilly devided to and between my three children Nicholas Ludwig and Ann Mary or there heirs. Allowing my wife the said Ann next page the said Ann Barbara Miller all the rents of the same untill it be sold as aforesaid. Provided also that if it shold so hapen that my daughter the said Ann Maria Shoud die under age and before marrage or issue then and in that case I do give and devise all that part of my real estate and personal estate herein before given and devised unto her the said Ann Maria, unto my two sons Nicholas Miller and Ludwig Miller to hold to them and there heirs and assigns for ever. Provided also that if my wife Ann Barbara Miller shold mary an other man, then and in that case I do give and bequeath all that one third part of my personal estate herein before given and bequeathed unto her, to my three children Ludwig Nicholas and Ann Maria to be eaquilly devided between them and there heirs after the death of the said Ann Barbara And lastly I do nominate and appoint my loving wife Ann Barbara Miller executrix and my two sons Nicholas Miller and Ludwig Miller executors of this my last will and testament hereby revoking and maiking nul and void all other or former will or wills Declaring this only to be and contain my last Will and testament In witness ___ ___ (fold) hereunto set my hand and affixed my seal the seventh day of March in the year of our Lord one thousand seven hundred and eighty three N B my Son Ludwig shall not have Power to sell the plantation that I now live on, nor his part thereof during the life of his mother. Signed sealed published & declared by the said testator as and for his last will and Ludwig Millor ? (signature) testament in presents of us witnesses Adam Wintrott Johannas Huber Hen Slagle York County Before me Jacob Barnitz Esq. Register, for the Probate of Wills and granting letters of Adminstration in and for the county of York in the state of Pennsylvania, personally came Adam Wintrott and John Huber two of the subscribing witnesses to the foregoing instrument of writing, and on their solemn next pg Solemn oath, Do severally say that they were personally present and saw the above named Ludwig Miller sign his name unto and think saw him seal this same and heard him publish the same as and for his last will and testament and that at the time of doing thereof he the said Ludwig Miller was of a sound and dispossing mind memory and understanding to the best of their knowledge and belief. And that they subscribed their names thereto as witnesses in presence of the said testator and at his request and also in the presence of each other at the same time. And the said John Huber further saith that he also saw Henry Slagle Esq. the other witness sign his name thereof as a witness at the same time Sworn subscribed Adam Wintrott at York the 13th Day of Oct 13th 1788 Johannes Huber October 1788 Last Will & Testa before me ment of Ludwig __Barnitz, Regr Miller deceased? Proved Oct 13th 1788 Ann Barbara Miller & Nichl Miller two of the Excrs sworn inventory in a Month of Reckoning in a year or when legally required. __Barnitz Regr Inventory filed same day May 25th 1790 2nd Inventory filed & Acct settled Copied & Letters issued --March 31st, 1790 Ludwig Miller the other Excr also sworn.
