YORK CO PA In the name of God amen I Ludiwick Miller of Germany township in the County of York and State of Pennsylvania--being weak of body, but of sound mind and disposing memory (thanks to God for the same) do this seventh day of June in the year of our Lord one thousand seven hundred and ninety eight make and publish this instrument of writing as & for my last will and testament as follows (that is to say) I order will and allow all my just debts to be well and truly paid Secondly, I give grant and beqeath to my wife--Margaret Miller, the one third of my personal estate after my debts are paid, to be holden of her absolutely, also the use of my lands for the purpose of mantaining (sic) and raising my young children until my youngest child be fifteen years of age provided she remain my widow, and from and after that time, she still remaining my widow I give & allow her the third part of the yearly rent of my land or a good and sufficent (sic) mantainance (sic) out of and from my land, & house room x every other privilidge (sic) necessary for her during her natural life, but if she marry then x from thence forth --her right & privildges (sic) on my land & every sum to come out, or from the same, shall cease & be for ever void to all intents @ purposes whatsoever, & ----&---- thirdly, I give grant and bequeath to my son Ludiwig Miller one bay horse, to my son Andrew one black stallion (sic), and to my son Simon one bay mare and to my son Abraham one--Colt, to be raised for him or bought at the expense of my Estate, and to beholden of each of them absolutely-- next page Fourthly, I order will and allow all and singular the rest and residue of my Estate personal to be sold at public vendue (except two cows that shall be kept for the use of my Youngest children) and the money arrising therefrom, to be equally divided amongst all my children, or their legall representatives if dead, the representatives of those dead taking only their parents share-- fifthly, I give grant and bequeath to my five sons John, Ludiwick,, Andrew, Simon and Abraham at the arrival of my youngest child at fifteen years of age, or at my wifes intermarriage all and singular my lands and tenements which I will be possessed of, at my decease equally to be divided amongst them, and to be holden of them their heirs and assigns for ever, on condition nevertheless, of allowing my wife yearly as aforesaid and to her bequeathed, she remaining my widow, and paying to each of my daughters or their legall (sic) representatives if dead, the sum of twenty five pounds each, the eldest to be first paid and each to be paid in yearly payments of twenty five pounds, the first in one year After my youngest child arrives at fifteen years of age, it being my true intent and meaning that if my wife intermarry that my lands shall immediately be vested in my five sons, yet nevertheless shall only have the use thereof, for mantaining (sic) my Young children, untill (sic) the youngest arrive at the age aforesaid, and further it is my true intent that my land aforesaid, shall be security in the hands of my sons, for the payments of daughters legacies, and allowing my wife as afore bequeathed to her, if she remains my widow, and untill (sic )the next page the lagacies aforesaid be paid, and the condition aforesaid fully performed, or secured to the satisfaction of all concerned , no sale of my land shall be of effect, unless it be of one or more of my sons to some one or more of the others provided always that if any of my children die unmarried and without lawfull (sic) issue, that the legacy or lagacies, share or shared of those dead as aforesaid, shall be equally devided (sic) to and amonst the survivors, in manner following, that is to say, if any of my sons die as aforesaid, their part shall be equally divided amongst their surviving brothers, but if any of my daughters die as aforesaid their legacy shall be divided equally amongst their surviving sisters and ??? ??? (not sure of the symbols here) lastly, I do herby (sic) constitute and appoint my two sons John and Ludiwick Miller executors of this my last will & testament to execute the same agreeable to the true intent & meaning thereof In testimony of this being my last will and testament I have hereunto set my hand & seal Dated as first above written---- Signed sealed published Ludwig MIller (signature) pronounced & declared by Ludiwick Miller as & in our presence who were in presence of each other and witnesses at his request R McIlhinny (can't read it) Michael Snider Jacob _____ York County, Before me Jacob Barnitz (Register) next page Register, for the probate of Wills and granting letters of Administration in and for the County of York in the State of Pennsylvania personally came Robert McIlhinny and Michael Schneider, Two of the Subscribing witnesses to the foregoing instrument of writing and on their solemn oath do personally say that, they were personally present and saw and heard the above named Ludwig Miller sign his name unto and seal and publish the foregoing instrument of writing as and for his Last Will and testament, and that at the time of the doing thereof he the said Ludwig Miler, was of a sound and disposing mind, memory and understanding to the best of their knowledge and belief. and that they subscribed their names thereto as witnesses in the prsence of the said testators and at his request, and further, that they also saw Jacob Acker (??) the other witness sign his name thereto as a witness at the same time.
