All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/york/ _______________________________________________ Source: York County, Pennsylvania Will Book K, P. 145, 11 Aug., 1797 Written: August 11, 1797 Recorded: August 10, 1801 YORK COUNTY, PENNSYLVANIA WILL BOOK K, p. 145, 11 Aug., 1797: In the name of God, Amen, I WILLIAM MUMMERT SR. of Paradise township, York County, Pennsylvania, being of sound and disposing mind and memory thanks to this Almighty God the same I make this my last Will and Testament in the following manner to wit; First and princably I recommend my mortal soul to the Almight God who gave it to me and my body I commit to the earth to be decently interred at the discretion of my executors herein in after named; Secondly, I order and impower my executors hereinafter named to sell all my real estate and personal estate to the best advantage at public sale except my wearing apparel which are to be divided among my sons as near equal as may be done; After my just debts are paid and when the remainder of my personal estate and the hard money which may be realized from my Plantation, I give and devise to my sons RICHARD, MATHIAS, JOHN, WILLIAM and JACOB and my daughters PARKEY intermarried to CHRISTIAN SWOBERLAND; ANN intermarried to LUDWICK SWOBERLAND, SUSANNA intermarried to JACOB NAGLE and CATHERINE intermarried to MATHIAS MYERS them and their heirs to be divided among them share and share alike; and the yearly payment of my Plantation, I give and devise unto my children aforesaid to wit; The two oldest, the first yearly payments, then the next two oldest and so on agreeable to the ages. As for my son JACOB, the youngest, then my son JACOB is to have so much as will come to his shear in from his proportion "Will." Not to be more than the one yearly payment will be if any be; besides what is willed to the children of my deceased daughter herein after mentioned is to be equally divided among my aforesaid children so what they shall have shares and share alike; I also give and devise unto GEORGE ILLIGENFRITZ one equal share or as much as one of my other children get to be paid to them out the last yearly payment of my Plantation. And I do hereby constitute and appoint my son MATHIAS MUMMERT and SAMUEL FAHNSTOCK of town Berlin, executors of my last will and testament and I empower the said executors to make and execute a good deed in the law so the _________ an_________ of my Plantation; and I do hereby revoke and dismiss all wills made herein made by me. This Indenture made on the 10th day of August Anno Domini one thousand eight hundred and one Between MATHIAS MUMMERT and SAMUEL FAHNESTOCK Executors of the Estate of WILLIAM MUMMERT late of Paradise Township, York County and state of Pennsylvania deceased for the one part and ABRAHAM TRIMMER of Reading Township and State aforesaid Witnesseth that the said MATHIAS MUMMERT and SAMUEL FAHNESTOCK for and in consideration of the sum of seven hundred pounds lawful money of Pennsylvania to them the said MATHIAS MUMMERT and SAMUAL FAHNESTOCK hand paid by the said ABRAHAM TRIMMER at or before the ensealing and at thise presents the Receit whereof thereby acknowledged and every part they do acquit and discharge for ever the said ABRAHAM TRIMMER his heirs and assignes by thise presents, Have granted __ to alined, released enseosses and confirmed and by thise presents To grant, bargain sell alien release enseoss confirm unto the said Abraham Trimmer, his Heirs and Assignes forever the following described Tract of Land situat in Paradise Township, York County Aforsaid coaled "Williamsburg." Beginning at the white oak thence by land of JOHN DELL, north eighty degrees East and hundred fifty one perches and four tenths to a White Oak thence by land of PETER GISE North thirty nine degrees West thirty three perches to a White oak, thence by land of CHISTIAN FOX North fifty four degrees and a quarter, Wrest thirty eight perches and three tenth to stones, North two degrees, West sixty perches to stones, thence by land of DANIEL ARNOLD, North Fifty nine degrees, West fifteen perches to a black oak North twenty four degrees, West sixty three perches to a post thence by land of HENRY JACKOBS, Soth sixty sixty degrees, West sixty two perches to stones thence by land of GOEROGE JACOBS. South fifteen degrees. West one hundred perches to Stones thence to Stones, thence by land of FREDERICK BRAND, North eighty seven degrees and an half, East twenty three perches to a stump and South eleven degrees, East fifty eight perches to the Beginning containing one hundred and seventeen Acres and one hundred and sixteen perches and Allowance of six p cent for roads, etc., Whereas the Commonwealth of Pennsylvania on the twenty eight day of January, Anno Domini one thousand hundred and ninety one by a Patent and Grant and confirm all the described land unto the above named WILLIAM MUMMART, deceased, AND WHEREAS the said WILLIAM MUMMERT since died having first made his last will and testament in writing bearing date the eleventh day of August Anno Domini one thousand seven hundred and ninety-se(ven) and thereby appointed MATHIAS MUMMERT and SAMUEL FOHNESTOCK his executors to sell his land in the following words and I empower the said executors to make and executire a good deed in the law of the purchaser of my Plantation an__ ______ and by the said will being since proven and remaining at the Register's Office at York and the said MATHIAS MUMMERT and SAMUEL FOHNESTOCK do by virtue of said will, sell, release and confirm all the above described Tract of Land unto the said ABRAHAM TRIMMER his heirs and Assigns forever together with all of the improvements thereon erected and built and all the appurtenances and He___ ___ tainments to the only use enifit and behoof of him the said ABRAHAM TRIMMER, his heirs and asisgns forever, subject to the reservations reeived in said patent, In Witness ehereof the said parties have to thise presents into __angebly sell their Hand and Seals the day and year above written.
