All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/york/ _______________________________________________ Last Will and Testament of Henry Mayrs (Meyer/Meyers/Myers) of Mountjoy township in the County of York N 645 Last Will & Testament of Henry Meyer, Deceased Proved January 13th 1785 both Exrs Sworn Inventory in a Month & Reckoning in a Year or when legally required Inventory filed same day letters Issued INSIDE In the Name of God Amen I Henry Mayrs of Mountjoy township in the county of York and State of Pennsylvania Inn holder Being sick and weak of body but of sound mind and memory thanks to God for his Mercies do this twenty ninth day of December in the year of our Lord one thousand seven hundred and eighty four Make and publish this my last will and testament as followeth (that is to say) Item 2ly I give will and bequeath unto my dearly beloved wife Barbara Mayr one black horse her saddle and bridle four cows at her own choise (sic) one bed and covering the Dressar (sic) and all its furniture as also one third part of the rent of my lands yearly whilst unsold if she remains my widdow (sic) and as soon as my youngest son is of age and my land sold as herein after directed and provided she still remains my widdow(sic) I then will and bequeath to her fifty pounds to be paid her by my executors. I also will and allow to my said wife Barbara one stack of hay for her cattle and grain in the bushell (sic) sufficent (sic) for her until (sic) next harvest--willed and bequeathed to her in lue (sic) of her full dower and share Item 3ly I order will and allow my executors immediately after my decease to expose to sale at vendue all my moveable goods except what is already bequeathed ) and the money arising therefrom to be taken to pay off my just debts and the overplush if any remains, together with the residue of the rent of my lands to be for the use of maintaining cloathing (sic) and schooling my children untill (sic) they shall arrive to the age of sixteen years and then the males to be bound to trades at their own choise (sic) and the famails (sic) to do for themselves Item 4ly I order will and allow as soon as my youngest son (as aforesaid) shall arrive to the age of twenty one years I impower and authorise (sic) my executors or anyone of them to sell and dispose of my lands to the best advantage and at the highest price in their power and the money arriseing (sic) therefrom I give devise and dispose of in the manner and form following (viz) to my daughters Barbara & Cathrine the sum of fifty pounds each and to my wife the sum already above mentioned on the condition aforesaid. And to my sons Jacob Henry John & George an equall (sic) devidend (sic) of the residue with reference had in payment to priority of Birth and resonable (sic) time allowed my executors to make payment after it shall be in their power and no intrest (sic) to be recovered on any of the said legacies unless by default of the executors Item 5ly Also my will and desire is that if any of my children is called off by death before they receive the lagacy (sic) by me to them bequethed (sic) without lawfull (sic) ishue (sic) that their legacy shall be devided (sic) to and amongst my surviving heirs Also my true intent and meaning being that the household goods & cattle shall be to the use and behooff (sic) of my wife Barbara for ever which is herein to her bequeathed And lastly I do hereby constitute and apoint (sic) my trusty friends (sic) Adam Wintrott and Robert McIlhinny both of Germany township in county of York Yeomen my whole and sole executors of this my last will and testament in trust to execute the same according to the true intent and meaning thereof investing them or any one of them with full power and authority to do or cause to be done any thing or things lawfull (sic) and necessary in the discharge of their trust and executorship ratifying and confirming this to be my last will and testament I n witness whereof I the said Henry Mayrs have hereunto set my hand and seal the day and year first above written (the words (whilst unsold) were interlined before signing signed & sealed published Henry Mayer (signature) pronounced and declared by the said Henry Mayr as his last will and testament in our presents who were in presents of each other and witesses at the testators request Samuel Hunter Charles Wilson David Walsh (all signatures) Sworn & subscribed at Samuel Hunter York the 13th day of January Charles Wilson 1785.
