D. 4-3-1854 Page 3 Citation Whereas Jacob Mouchet having applied to me for Letters of Administration on the Estate of Thomas D. Cook late of Anderson District deceased. The kindred and creditors of said deceased are therefore cited to appear in the Court of Ordinary for Anderson District at Anderson Court House on Monday the 17th Instant to show cause of any they can why said letters should not be granted. TO JACOB MOUCHET Whereas THOMAS D. COOK, late of Anderson District, deceased, lately died intestate, having whilst he lived, and at the time of his death, divers goods, rights and credits within the District aforesaid, by means whereof the full disposition and power of granting the administration of all and singular the foods, chattels, rights and credits of the said deceased, and also auditing the accounts, calculations and reckonings of the said administration, and a final dismissal of the same, to me is manifestly known to belong, -- I desiring that the goods, chattels, rights and credits of the said deceased may be well and truly administered, converted and disposed of, do hereby grant unto the said JACOB MOUCHET in whose fidelity in this particular I very much confide, full power, by the tenor of thee presents, to administer of the goods, chattels, rights, and credits of the said deceased, which to him in his life-time and at the time of his death did belong, and to ask, levy, recover and receive the same, and to pay the debts in which the deceased stood obliged, so far forth as his goods, chattels, rights and credits will extend, according to their rate and order of law; being first sworn on the Holy Evangelist of the Almighty God, to make a true and perfect inventory thereof, and to exhibit the same into the Ordinary's office in Anderson in order to be reported, on or before the first day of July now next ensuing, and to render a just and true account, calculation and reckoning of the said administration, when thereunto required; and I ordain and constitute you the said JACOB MOUCHET administrator of all and singular goods, chattels, rights and credits of the said deceased. STATE OF SOUTH CAROLINA, Anderson DISTRICT IN THE COURT OF ORDINARY KNOW ALL MEN BY THESE PRESENTS, That we JACOB MOUCHET, ABNER CLINKSCALES and LEWIS CLINKSCALES, are holden and firmly bound full and just sum of Fifteen hundred Dollars lawful money of this State, to be paid to the aforesaid Herbert Hammond Ordinary, or his successor in office, or their certain Attorney or assigns, for which payment well and truly made and done, we bind ourselves and every of our heirs, Executors, and Administrators, for the whole, and in the whole, jointly and severally, firmly by these presents. Sealed with our Seals, and dated the 17th day of April in the year of our Lord one thousand eight hundred and fifty four. The condition of the above obligation is such, that if the above bound JACOB MOUCHET Administrator of the goods, chattels, rights and credits of and singular the goods, chattels, rights and credits of the said deceased, and which have or shall come into the hands, possession or knowledge of the said JACOB MOUCHET or in the hands of any other person or persons for him and the same so made, do exhibit the same in the said Court of Ordinary, when he shall be thereunto required; and such foods, chattels, rights and credits do well and truly administer, according to law, and do make a perfect and true account of his actings and doings therein, when required by the said court; and the rest of the goods, chattels, rights and credits which shall be remaining upon the account of the said administration, the same being first allowed by the said court, shall pay and deliver unto such persons respectively as are entitles to the same by law, Then this obligation to be void, or else to remain in full force. COOK late of Anderson District, deceased, and that although he died since the first of Marsh he left no crop neither any person to plant or --?-a crop having no land of his own, and being in debt probably as much or more than his Estate is worth and that little subject to waste and liable to be destroyed your petitioner confidently believes that is would be most advantageous for the parties in interest to bring the little property to sale as early as possible and that is so doing it will not violate the law or the spirit and intention thereof as above stated there being no crop. Except a small patch of wheat which your Petitioner thinks had also better be sold-Respectfully Submitted this 17th day of April 1854.
