Magill one of the acting Magistrates in and for said District, Mary Johnson [sic] a resident of the State & Dist. aforesaid aged 85 years, who being first duly sworn according to Law, doth on her oath make the following declaration in order to obtain the benefit of the provision made by the act of Congress passed July 4th 1836, That she is the widow of James Johnson or Johnston, decd. of Chester District, S.C. who was a private, Lieutenant, Capt. and Adjutant in Col. Lacy's Regiment of the South Carolina Militia, during the War of the revolution, but to give the particulars of his said service viz the commencment and termination of each tour of duty she cannot but that he was generally in Service to her personal knowledge, after their marriage in Jany 1780, till the end of the war; a portion of which time she believes he served under Captains Adams & McClure, as horseman & Footman, That during the war he was in the following engagements, viz. Hangingrock, Rockymount, Kingsmountain, Hooks Defeat at Brattons, and at Sumpter's Defeats, on Fishingcreek, besides in Several skirmishes towards the Close of the War, She further declared that she was married to the said James Johnson, in Chester District, S.C., in the Month of January Seventeen hundred & eighty (1780) by Philip Walker Esq.; that her husband the aforesaid, James Johnson died on the 13th March 1797 Seventeen hundred & ninety Seven; and that she has remained a widow ever since that Period as will more fully appear by reference to the proof hereto annexed; She also declared that she has a family Record which is in the hand writing of her said husband shewing the ages of their children which she believes to be correct & true, and the same is hereto appended. Woodward and Judge of the Court of Ordinary for the District and state aforesaid which court is a court of Record do hereby Certify that it has been shown in evidence to the satisfaction of this Court by James E. Johnston and John M'Cully who are duly attested witnesses of Chester & Fairfield Districts So. Ca. that Mary Johnston widow of James Johnston last of Fairfield District deceased departed this life in Chester District South Carolina on the thirty first day of May one thousand eight hundred and fifty four leaving the following children her surviving To Wit Jane Sulivan, David Johnston, Ellen M'Daniel, John G. Johnston, and James Johnston and that Jane Sulivan since died and that David Johnston Ellen M'Daniel John G. Johnston and James Johnston are now her only surviving children and all of lawful age and that the said Mary Johnston was a pensioner of the United States at the rate of $206.00 per annum and that James Johnston her son is the Administrator of James Johnston husband of her said Mary with the will annexed, and that his Bond was filed in this office on the Eight day of Decr. 1854 for the amount of $1500. and that he is gentleman in independent circumstances and that she drew her pension up to the fourth of March one thousand eight hundred and fifty four.
