All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/sc/scfiles.htm ************************************************ Contributed for use in the SCGenWeb Archives by: Wes Phinney, Jr. Formatted and uploaded by Victoria Proctor. -------------------------------------------------------- Source: Wpa Chester Co. wills Vol. 3, Bk A-1, pp201-202 Written: September 19, 1846 Recorded: February 18, 1848 I, Patrick Phinney of Chester District, farmer, being in a moderate state of health of body and sound disposing mind, memory and understanding, praised be to God for the Same, do make this my last will and testament in manner and form following, to wit, I recommend my soul to God who gave it, and my body to the dust, to be decently buried at the descretion (sic) of my Executor I Give divise and bequeath to my wife Peggy Phenney, during her natural life, the sole use occupancy and possession of the mansion House and plantation or Tract of Land called the Blair tract whereon I now live, containing one hundred and sixty five acres more or less; one horse, plow and Gewre, two cows her own choices of the stock, the beds bedclothing, household and kitchen furniture, also She is to have the labours of my nigro boy Alfred during her natural life. I allow all my Just debts and funeral Expenses to be paid. I Give devise and bequeath to my son James Phinney sixty dollars to him and his heirs for ever. I Give devise and bequeath to my daughter Mary M Phenney, five dollars in cash, and the bed bedStead and clothing now claimed by her to her and her heirs forever. I Give devise and bequeath to each of my Sons, to wit, Thomas Phenney, Christopher Phenney, Robert Phenney, Charles Phenney, and Hugh Phenney, one dollar each. I Give divise and bequeath to my Grand son the son of William Phenney deceased of Farefield(sic) District, the sum of fifty dollars, to him and his heirs for ever. I allow my boy Slave alfred to be will treated and Executor to furnish him with such Small sums of money he may deem prudent I Give devise and bequeath to my friend David Wilson Esquire, of Rockey Creek, all the remainder of my ..state both Real and personal, to him and his heirs for ever. and I do hereby nominate constitute and appoint, the Said David Wilson, sole Executor of this my last Will and Testament hereby revoking and making Void, every other Will or wills by me heretofore made and do declare this to be my last will and Testament. In witness Whereof, I the said Patrick Phenny have hereunto set my hand and Seal this Ninteenth day of September, in the year of our Lord, one thousand Eight hundred and forty Six. Recorded Book A Page 72 Apartment No 95 Package No. 1555 Amended Chester District Deed Book 66 No. 364, as follows: David Wilson to DEED James Phinney and others State of South Carolina Chester District Whereas Patrick Phinney of the State and District aforesaid duly made and executed his last Will and Testament on the Nineteenth day of September A.D. 1846 and died, having the same unrevoked and in full force, and the said Will are the following clauses viz." Now know all Men by these presents, that I David Wilson of the State and District aforesaid for and in consideration of the regard and esteem which I have towards the children of the said Patrick Phinney dec'd., and in order that the intentions of the said Patrick in regard to the legacy left me in the said Will above mentioned, and also in consideration of one Dollar in hand paid me, do give, grant, bargain, sell, and release the remainder of the estate of the said Patrick Phinney (after the payment of the legacies in which Will mentioned the debts of said estate, and after the expiration of the life, estate of the said widow Peggy Phinney) as follows viz., I give to Thomas Phinney and his heirs forever sixty dollars, to Mary M. Phinney Sixty Dollars to her and her heirs forever, to Christopher Phinney to him and his heirs forever, to Robert Phinney Sixty Dollars to him and his heirs forever, to Charles Phinney Sixty Dollars to him and his heirs forever....
