Deed South Carolina To all whom these presents shall come, I, Mary Cone of the Parish of St. Paul's in the District of Colleton in the State aforesaid, send Greeting, whereas in and by a marriage settlement, duly executed on the second day of May A.D. 1849 between John Cone, of the first part, Mary Miller, of the second part, and Edward D. Hutson, of the third part, it was agreed by and between the said parties, in contemplation of a marriage, then about to be had between the said John Cone and the said Mary Miller, that all the propery, Real and Personal, of the said Mary Miller, consisting of a tract of land situated, lying, and being in the Parish of Saint Paul's, containing six hundred acres, all her household furniture, one mare and colt, three cows and calves, lot of hogs & co. should be conveyed to Ed. D. Hutson, Trustee for the following uses and purposes, to wit, for the use of Mary Miller, until the solemnization of said intended marriage, and from and immediately after said marriage, to permit the said John Cone to receive the rents and profits thereof. And should the said John Cone die before the said Mary Miller, then all said property to rest absolutely in the said Mary Miller but should she, the said Mary Miller, die first, then to such person or persons, as she may direct, and whereas I am desirous that all of the aforesaid property, real and personal, shall, from, and immediately after my decease be equally divided between my children, to wit, Thomas Miller, Daniel Miller, Isaac Miller, Martha Ann Miller, and Lydia Hutson, wife of Edward D. Hutson by nature of the powers conferred upon me by aforesaid marriage settlement. Now therefore know all men by these presents, that I, Mary Cone of St. Paul's Parish in the District and State aforesaid, under and by virtue of the power aforesaid, and for and in consideration of the love and affection which I have and here unto my said children, Thomas Miller, Daniel Miller, Isaac Miller, Martha Ann Miller, and Lydia Hutson, wife of Edward D. Hutson, and in further consideration of the sum of one dollar to me in hand paid have given, granted, bargained, sold, and released, and conveyed, and by these presents do grant, bargain, sell, and release and convey unto the said Thomas Miller, Daniel Miller, Isaac Miller, Martha Ann Miller, and Lydia Hutson, their and each of their Heirs, Executors, Administrators, or Assigns, in equal shares or proportions, all the property, real and personal, covered by the marriage settlement aforesaid, to wit, all that tract of land situated, lying, and being in the Parish of St. Paul's in the District and State aforesaid containing six hundred acres butting and bounding on lands of Geliyer (?) and Branton, and purchased by me from, as also all the household furniture, the mare and colt, cows, calves, & hogs as aforesaid. TO HAVE AND TO HOLD, all and singular the said real and personal property hereby granted, bargained, sold, and conveyed, and every part or parcel thereof unto the said Thomas Miller, Daniel Miller, Isaac Miller, Martha Ann Miller, and Lydia Hutson, wife of Edward D. Hutson, their and each of their Heirs, Executors, Administrators, or Assigns forever to be equally divided between them provided always and these presents are upon this special trust and confidence, and upon this express condition that they, the said Thomas Miller, Daniel Miller, Isaac Miller, Martha Ann Miller, and Lydia Hutson, their heirs, executors, administrators, or assigns, shall and do permit and suffer me, the said Mary Cone, to have use, keep, possess, and enjoy all and singular the real and personal property aforesaid, for and during the term of my natural life, without paying or yielding up anything for the same, or in respect thereof. And from and immediately after my decease, they, the said Thomas Miller, Daniel Miller, Isaac Miller, Martha Ann Miller, and Lydia Hutson, their and each of their heirs, executors, administrators, or assigns shall or may lawfully have, hold, possess, and enjoy all of said property, real and personal, in the equal shares or proportions as herein after set forth. In witness whereof, I have hereunto set my Hand and Seal, this thirtieth day of August in the year of our Lord one thousand eight hundred and fifty.
