All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/sc/scfiles.htm Submitted by Beth Collins, 9 Feb 2009, for use in the SCGenWeb Archives ************************************************ South Carolina Wills (WPA Transcription) Vol. 5 p. 274-275 Joseph Andrew In the Name of God Amen I Joseph Andrew of Colleton County in St. Bartholomew Parish in the province of South Carolina being sick and weak in Body but Sound in mind and memory Blessed Be God Do Constitute this my Last Will and Testament and Desire that it may received as Such by all People, -- Impremis I Give and Bequeath to my son Joseph Andrew all my Estate both Real and Personal to him and the Heirs of his Body for ever But if it should so Happen that my Son Should Dy without Issue then and in such Case my will is that my whole Estate Both Real and Personal shall go to and Belong to the Next Male Heir of the Name and Family and if the said next Male Heir Should Dy without Male Issue then it shall go to the next Male Heir and so on in the Male Line Successively for ever - It is my will a ___ is that if any Heir after my Son Joseph's Decease (Not of his Body Shall inherit my Estate then and in such Case He Shall Cearfully make a Distinction Between that Part of his Estate Decended to him from me and any other part of his Estate whatso ____ that so they may not be ___ one into the other and so Confounded together no but that they may be separated if need be. That is to Say not only the original stock of Negroes and Chattles but Susessively according to Generations for ever. Item my will also is that my sister Ann Campbell Shall Enjoy the Lease She now Lives on until it shall be Expired and of her the Expiration of the said Lease I Impower my Executors Hereafter mentioned who shall have all Powers (and my will is that they Lease to Her for the Term of Twenty Years a Plantation of Land Containing one Hundred Acres in Sum Convenient Place of my Lands as they shall think most proper. Item my Will also is that my sister Hannah Murphy Shall have her Residence on Sum part of my Lands (according to the Discretion of my Executors) Dureing Her natural Life: Item my will also that after my Just Debts are paid (which are to be paid as it is made on the Plantation) I Give and Bequeath one Negro to my sister Hannah Murphey which said Negro Shall be bought for her whom Negros Shall be again Imported into this province. I Appoint my Nephe John Andrew and my Nephe Thomas Andrew and my friend John Mitchell to be Executors of this my Last Will and Testament my will also is that my Son Joseph Andrew be Deem'd of full age to Act for Himself at twenty years.
