Franklin (NOT associated with Tracking Your Roots) lisafranklin2004@earthlink.net January 18, 2017, 11:25 pm Source: Darlington County Sc Will Book Vol 8-10, 1829-1859 Pgs 11-13 Written: October 16, 1840 Recorded: January 18, 1841 Page 11 William Burris Will State of South Carolina } Know all men by these presence that I Darlington District } William Burris of the State & District aforesaid being weak in Body but sound in mind and of a disposing disposition do make and do make and ordain this my last Will and Testament First it is my wish and will that all my just debts should be paid Item ) I give and bequeath unto my beloved wife Jane Burris all the land lying on the East side of the road from Jefferses Creek to Blk Creek Bridge or with a line from Jefferses Creek on to the back line laid off for my son Ira E Burris I also give her one of my horses which she can chose one Feather Bed Sted and Furniture and ten head of hogs one hundred bushels corn and in the event of my wife’s marrying the land is to be taken from her by my Executors for the benefit of my three youngest children namely Robert Lenn George & Sarah Jane I give to my son Robert Lenn Burris a negro boy by the name of Tom and my shot gun I give to unto my son George Burris a negro boy named Dawson I give unto my daughter Sarah Jane Burris a negro boy named Lisbon one feather bed and furniture I also give unto my sons Lenn & George and my daughter Page 12 Sarah Jane one cow and calf also to be chosen out of the Stock by themselves after my just debts are all paid then it is my will that the balance of my Estate shall be equally divided among all my children that are hereafter named namely Ira E Burris William Mitton Burris Emily Fraser Samuel Burris Jane Elizabeth Burris John Burris Martha Solmonds Robert Lenn Burris George Burris & Sarah Jane Burris I give unto Benjamin Burris ten dollars which is to be all that he is to have out of the whole of my Estate I do hereby nominate and appoint Ira E Burris and James Cole as my lawful Executors. I do hereby make and ordain this my last Will and Testament revoking all other wills In Testimony whereof I have hereunto set my hand and this the Sixteenth day of October one Thousand Eight hundred and Forty and in the sixty fifth year of American Independence of the United States of America Thos Stanly } William Burris {seal} Angus Gilchrist } Wm L Moye } South Carolina } Darlington District } January 18th 1841 Personally came Angus Gilchrist who being one of the subscribing witnesses to the within will who being duly sworn made oath that he was present and did see William Burris the Testator within named sign seal and acknowledge the within instrument of writing for the purposes therein set forth and that he was at the same time of a sound disposing mind memory and understanding as their deposant doth believe and that he subscribed the same as a Witness in the presence of the said William Burris and that Wm L Moye and Thomas Stanly signed the same as witnesses at the same time and in the presence of the Testator also Ervin B Brunson } Angus Gilchrist O. D. D. } Page 13 South Carolina } In the Court of Ordinary Darlington District } January 18th 1841 Ira E Burris was this day duly qualified as Executor to the within will Ervin B Brunson O. D. D. The State of South Carolina } In the Court of Ordinary Darlington District } January 18th 1841 I do hereby certify that the within Will was this day proved Before me in the common form of law by Angus Gilchrist Ervin B Brunson O. D. D. Additional Comments: Note: The 24 Mar 1830 will of James Chandler of Amite Co, MS (Amite County MS Will Book 1818-1922 pgs 102-104) bequeaths “to the children of my deceased daughter Martha Burris late wife of William Burris of Darlington District South Carolina the number and names of them I do not know four thousand dollars to be equally divided between them if however any of the children of my said daughter shall have died leaving heirs of his or her body then such deceased Parents part of the said four thousand dollars to go to the said heirs of his or her body”.
