Court House, by Susan Wood (Hillman), Columbia, Alabama.] [Handwritten note: 1859-74 Wills, Bk. 11 pg 95] [Scanned by David A Wood III, 2/11/2001] In the name of God, Amen, I, Henry Wood of State of South Carolina,, Darlington district, being in good health and sound mind do make, ordain and declare this instrument which is written in my own hand, and every page subscribed with my name to be my last Will and Testament, revoking all others Item I It is my will and desire that my just debts of which there are but few and none of magnitude be as punctually and speedily paid after my decease as practicable and that the Legacies herein after bequeathed be discharged as soon as circumstances will permit and in the following manner. Item II To my beloved wife Catherine Wood, should she survive my death, I give and bequeath the use benefit and profit of my plantation with the household and kitchen furniture and such horses, cattle and hogs as she may think necessary for her own use, with one full year's allowance of provisions. I also give my wife these negro servants, Davy, Phillis, Stephen, Genny, Frank, Anderson, Osmon, Sorrow during her natural life, and at her decease these negroes to be disposed of as herein after directed. Item III I give and bequeath to my first son, John Alexander Wood, these Negro servants, Hanner, Carolina and Sam during his life. Item IV I give and bequeath to my daughter Elizabeth Ann Garland one Negro girl named Sharlott in the year 1833 being then 10 years of age with her increase during her natural life. I also give or devise to my daughter the said Elizabeth to her and to her heirs of her natural body forever, twelve hundred dollars, either in land or money as she may choose and my Executors herein after named are directed should my daughter make choice of land to have the same impartially appraised and surveyed off to her at the expense of my estate (not however til after the death of my wife, Catherine), as will raise the money and pay the said sum of $1200, to my daughter Elizabeth Ann Garland. Item V I give and bequeath to my second son, William Henry Wood, these negroes servants, Namely, Wesley, Easter, Emma to have and to hold forever. Item VI I give and bequeath to my third son, David Gregg Wood these negro servants: Ransom, Seely and Friday to have and to hold during his natural life. Item VII I give and bequeath and devise to my fourth son, Joseph Butler Wood that tract or piece of land lying on Jeffers Creek, formerly known as the Cofield. I also give and bequeath to the said Joseph B. Wood these negro servants, Nameley, Jarvas, Nelly and Rachel during his natural life. Item VIII The Negroes I willed to my beloved wife Catherine Wood, at her death, it is my will and desire should be divided between my four sons as follows, Fillis, Stephen, and Laura to my first son John A. Wood, during his natural life and after his death to his children by his present wife and to their heirs forever. Genny and Anderson to my second son William H. Wood during his natural life and at his death to his children by his present wife and their heirs forever. Davy, Frank and Osmon to my third son David G. Wood during his natural life and after his death to his children and their heirs forever. Item IX There are two of the negroes that I have not named in any foregoing Items to wit: Sophy and Abram, they are very much afflicted and it is my wish and desire that Sophy have her choice which one of my children she will live with and that Abram go with his two children. Item X At my decease it is my wish and desire that whatever should remain of my estate either personal or real that is not named and bequeathed in these items shall be sold and the proceeds of such sale be equally divided between my four sons, John, William, David and Joseph. Item XI Lastly, I constitute and appoint my two sons David G Wood and Joseph B. Wood executors of this my last Will and Testament to carry out provisions and intentions in the construction of which it will readily be perceived that no professional character has been consulted or had any agency in this draught, but it is my will and my desire that it may stand firm in witness of each and all in the year of our Lord one thousand eight hundred and fifty seven and of the Independence of the United States of America Eighty second year.
