Holloway and others vs. Matilda Holloway, adminx. Bill for Partition. Rich'd L. Holloway, Dan'l P. Holloway, Ransom Holloway, William Dorn Jr. and his wife Elizabeth Dorn, Nancy E. Holloway vs. Matilda Holloway, Admix. Your orators, Richard L. Holloway, Daniel P. Holloway, Ransom P. William Dorn Jr. and wife Elizabeth Dorn; Nancy E. Holloway, minor by next friend Daniel P. Holloway; Emma Holloway, widow of Henry W. Holloway, deceased state that Ransom Holloway, late of the District, departed life 14 May 1862 without a will. His children Richard; Ransom P.; Elizabeth, wife of William Dorn Jr.; Nancy Holloway; Russell H. Holloway, who died on or about 13 May 1862, leaving neither wife nor children; Henry W. Holloway, who died on or about 28 July 1864 leaving a widow Emma Holloway, orator with infant child which has since died. Ransom Holloway had the following real estate: one tract of 650 acres more or less adjacent John Trapp, Dr. Thomas Lake and ? Brooks; second tract of 230 acres adjacent Lewelyn Broom, Williamson Williams and Mrs. (blank) Rhodes and estate of said deceased. His estate had been committed to hands of his widow, Matilda Holloway and is sufficient to pay his debts. Orators ask for partition. Filed 1 September 1866. On motion of H.W. Addison, Solicitor, Daniel P. Holloway be admitted as friend of infant Nancy E. Holloway and present this on her behalf. Z.W. Carwile. 1 September 1866. John Trapp, Lemuel Brooks, Dr. Thomas Lake, Simpson Mathis and W.H. Holloway are to partition and divide the real estate by order of Z.W. Carwile. 8 Oct. 1866. Answer of Matilda Holloway to the Bill of Complaint, filed 6 September 1866. She has no objection to partition of land and agrees that the personality of Ransom's estate is enough to satisfy debts against estate. Signed: Matidla Holloway. It was determined that the land can not be fairly divided, so is to be sold to family, not at public auction. The first tract is valued at $3.50 per acre in gold or equal in currency. The second at $3.00 per acre in gold or equal currency. The first tract is assigned to Matilda Holloway and D.P. Holloway upon paying the prices assessed and the second tract is assigned to to Ransom P. Holloway upon paying prices assessed. 24 October 1866.
