I, Daniel PARKER, being weak in body, though of sound mind & memory & understanding. I desire that my present crop of cotton & my still and negro man Peter to be sold & the money applied to the payment of my just debts, and the overplus if any to remain in the hands of my executrix for the support of my family. I desire that my wife Elizabeth Parker shall have sole use of my plantation and tract of land containing 96 acres where I now live until my youngest son Richard Parker become eighteen years of age, at that time the tract shall become unto my son James Parker at his full share of my estate. I give unto my two grand-chn. viz. Salina & John Gardner, son & dtr. of my dtr. Rachel Gardner decd. the sum of 5 shillings to be paid when at the age of twenty one yers, in full for their mother part, as I have already given to her before. I desire that the balance of my property shall be appraised & remain in the hands of my wife for the support of herself & the chn. & to be divided amongst my wife & the six chn. viz. Judah, Elizabeth, Matilda, Ezekiel, John and Richard. I desire that my dtrs. may have their share when they marry or when my son Richard is eighteen years old. Heirs are: Richard and Ezekiel Parker; Mrs. Charlotte T. Mitchell; S. C. Kenney, all residents of Perry County, Ala.; Mrs. Ann Day, wife of Thos. Day, and a resident of Butler Co., Ala.; and James Cooper, a great-nephew, whose mother was Salina Mobley, and when last heard from was a resident of Shreveport, La. This petition dated 15 Jan. 1867. Receipt of Mrs. Day is Signed Rachel Ann Day. S. Letcher made receipt fo rhis distributive share. Wm. Mixson, admr. of James Parker, is notified that Wm. Parker has filed an application for his share of said est., stating he is an heir at law. 8 Jan. 1872. Dr. C. D. Parke rendered bill for medicine and medical services. Ellis Mixson and J. W. Wm Parker says he is entitled to 1/2 / 1/4 ? of the estate of James Parker. Dr. Wm. Mixon, Admr. Land belonging to est. of James Parker was sold 26 Nov. 1870 to J. W. Clay. Land in T18 R11 & R12. S. Y. Cater also bought some of the land. Ellis A. Mixon and Massena Goodwin testified that the land is partly in Autauga Co; some in Woodlawn Beat in Dallas Co. and some on Mulberry Creek (in Dallas Co.). 25 Aug. 1865 S. C. Kenney represents that James Parker died in April 1865, leaving a will in Possession of Jackson Clay. On a slip of paper; Perry Co., Ala. Ezekiel Parker, Richard Parker, S. C. Kenney, Charlotte T. Mitchell, Thos. Day, and wife Rachel, Lowndes Co. Matilda Williams, Mary Cole, and Priscilla, wiley, address unknown. 8 Jan. 1872. Wm. Mixon, admr. of est. of James Parker, dec'd, answers petition filed Dec. 22, 1871, by William Parker, claiming he is a legal heir of said James Mixon denies and says heirs are: 1. & 2. Richard and Ezekiel Parker, bros. of Jas. Parker. 3. Mrs. Rachel A. Day, who is the dau. of Ann Gardner, who was a sister of Jas. Parker, dec'd. 4. Mrs. C. T. Mitchell, who was dau. of Mrs. C. Kenney, who was sister of Jas. Parker. 5. S. C. Kinney, who was son of Mrs. C. Kinney, who was sister of James Parker. These are the only heirs. Mixon says that Jas. Parker was never married and had no legitimate children. No. date. Wm. Mixon's petition to sell lands belonging to estate of Jas. Parker. 640A., all in T18 R11. Heirs are: 1. Kenney, who was son of Mrs. Elizabeth Kinney, dec'd, who was sister of James Parker, dec'd, and who lives at Dixie, Baker Co., Ala., and is of full age. 5. Mrs. C. T. Mitchell, widow of Thos.
