WILL OF ELIZABETH AUSTIN Fairfield County, South Carolina August 4, 1802 Transcribed by Carolyn J. Cooper [This will is transcribed with its original spelling and punctuation except for replacing the "f" used at the time for "s". Items in brackets are my comments.] [Elizabeth was the widow of Bartholomew Austin who had died in 1771.] In the Name of God Amen. I Elizabeth Austin of the State of South Carolina and Fairfield District, being weak of body but of perfect Mind and Memory thanks be to God; Calling to mind the mortality of my body and knowing that it is appointed for all Men once to die do Make and Ordain this My last will and Testament; that is to say, Principally and first of all I Give and Recommend my Soul into the hands of Almighty God that Gave it, and my body I recommend to the Earth to be Buried in a decent Christian Burial at the discretion of my executors, nothing doubting but at the General Resurrection I shall receive the same again by the Mighty power of God; and as touching such worldly estate where with it hath pleased God to bless me with in this Life I give devise and dispose of the same in the following manner and form: First I give and Bequeath unto my son John Austin one half of a plantation or tract of land originally Granted to William Newman containing two hundred acres situated on a branch of Little River on Austin Mill Creek; or should the Heirs of the said William Newman, Deceased, refuse to take titles to said plantation or tract of land then and in that case I give and bequeath one half of whatever may be recovered of the Heirs of Wm Newman - Bond Given by the said William Newman making titles to me of the said land. I also Give and Bequeath to Robert Ferrel and my Granddaughter Elizabeth Ferrel [Ferrell] the other half of said plantation or tract of land or one half of whatsoever may be received of said Bond during the term of her Natural life and at her decease to be Equally divided amongst the children of the said Elizabeth Ferrel should she have any living at that time. Should she have no Children living at that time then and in that case I Give and Bequeath the same to be equally divided amongst the children of my daughter Edy. [Edith Austin Hatcher, wife of William Hatcher. Elizabeth Ferrel was their daughter.] I also give and Bequeath to my daughter Edy and William Hatcher one plantation or tract of land containing one hundred fifty acres situated on Mill Branch otherwise called Mill Creek being the plantation I now live on during their Natural lives and at their decease to be Equally divided amongst the children that my daughter Edy should have, except Elizabeth Ferrel which is to have no part of said land. I also Give and Bequeah to my Daughter Edy and William Hatcher one horse I now have, also all my stock of Cattle and hoggs, also all my plantation tools household and Kitchen furniture Except Seventy one dollars and fifty cents and one Riffle gun Which I leave and Bequeath in the following manner VIZ, I leave and bequeath to my Grand son Bartholomew Austin Busby one Riffle gun also as much of my personal estate as will buy him a horse and saddle valued at seventy dollars - I also give and Bequeath to the Heirs of son William Austin one shilling; also to the Heirs of my son Drury Austin one shilling; also to the Heirs of my son Davis Austin one shilling; also to the Heirs of son Bartholomew Austin one shilling. I also Give and Bequeath to my Daughter Mary Newman [wife of William Newman mentioned above] one shilling. I also give and Bequeath to my two sons James and Joseph Austin one shilling each. Also I do hereby constitute make and ordain my son John Austin Executor and my daughter Edy Executrix of this my last Will and Testament and I do hereby disallow revoke and disannul all and former testaments Wills legacies or Bequests by Me in any wise made Willed or Bequeathed; Ratifying and Confirming this and no other to be my last will and testament in Witness where of I have hereunto set my hand and seal this fourth day of August one thousand eight hundred & two.
