I Jesse Garrett Senr. being of sound and disposing mind & memory, but calling to mind the uncertainty of life and being desirous of making a distribution of such wordly estate as I may have been blessed with in this life, do make and ordain this my last Will & Testament as follows: I give and bequeath unto my wife Elizabeth Garrett during her natural life and at her death to be sold by my Executors hereinafter named, and the money to be disposed of as I shall hereinafter direct, the following Real and Personal Estate, to wit: The tract of land whereon I now live containing Two Hundred Acres, more or less, adjoining lands of Dr Hugh Saxon, the widow Goodjion, William Lindley and others; Sam and his wife, Hannah, Sarah, and her son, Henry, Elizabeth and Isaac together with all my household kitchen furniture, or as much as she may want. I direct furthermore that upon the death of my said wife, Elizabeth all the above mentioned property both real and personal be sold by my Executors hereinafter named, and the proceeds of said sale be divided into seven equal parts or shares and that one share be paid to my son John Garrett to him & his heirs forever; and that one share be paid to my son Thomas H. Garrett, to him and his heirs forever; and that one share be paid to my son Edward H. Garrett to him and his heirs forever; and that one shasre be paid to my son Jesse Garrett to him and his heirs forever; and that one share be paid to my daughter, Polly Cook, to her & her heirs forever; and that one share be paid to the children of my deceased daughter Fanny Martin, to them and their heirs forever; and that one share be paid to daughter Betsey Asheley, to her and her heirs forever; also give and bequeath to my sons, thos Garrett and Jesse Garrett, in trust for the use and benefit of my son, John Garrett, the tract of land on which he, the said John Garrett now lives, containing one hundred acres, more or less, during his lifetime; and at his death the same to belong to his wife Polly during her natural life if she should be the longest survivor and at their death the said tract of land to be sold by my Executors hereafter named, the money divided equally among their children, to them and their heirs forever. I also give and bequeath to the said Thomas Garrett and Jesse Garrett, in trust for the use and benefit of my son Stephen Garrett and his wife Polly during their life a negro man named Alexandria, and at their death, the said negro to be sold and the money divided equally among their heirs by my Executors. I consider tha that makes Stephen equal with the rest of my children. I hereby direct my Executors to Sell a negro girl Matilda and divide the proceeds of the sale among the children of my deceased daughter Fanny Martin to be paid to them as they arrive to lawful age or marry. I also will & bequeath unto my son, William H. Garrett, the notes which I hold on him, which I consider will make him equal with the rest of my children. I furthermore, direct my Executors to sell a negro man named Martin, together with all the remainder of my property not herein specially disposed of, on a reasonable credit, after my death, and that the proceeds of said sale, after payment of my just debts and funeral expenses, be divided and paid out precisely in the same manner as is directed for the property herein before directed to be sold at my death , with this exception, that my wife must first take a third part of the proceeds of said sale, and after her death, to make the same disposition of her portion, or her third, as is done with the foregoing named property. Lastly, I nominate, constitute and appoint my sons, Thos Garrett and Jesse Garrett, Executors of this my last Will and Testament. Signed, sealed and acknowledged by Jesse Garrett, Senr as and for his last Will and Testament, in whose presence, and at whose request, we have witnessed and in the presence of each other subscribed our names as witnesses to the due execution of the same; this the twenty second day of September, One Thousand Eight Hundred and Forty-seven.
