Contributed to The USGenWeb Archives by: Debra Crosby 17 Feb 2002 ---------------------------------------- Will of Robert Hussey Marion District South Carolina South Carolina Marion District In the name of God Amen I Robt Hussey of the State and district aforesaid being of sound mind, disposing mind & memory but being weak in body and calling to mind the uncertainty of life and being desirous of all such worldly estate as it hath pleased God to bless me me with, do make and ordain this my this my last will in manner following that is to say; Item 1 : I will & bequeath to my dearly beloved wife Sinthy two calves for her use and benefit and the division of the rest of my personal estate also I Robert Hussey of the aforesaid state and district the whole of my lands all of the farm now ???? to my beloved and to my four sons; Archibald Hussey and William Hussey, John Anderson Hussey & Lewis Gregory Hussey to have and to hold forever said lands being as my deed shall show unto the following under the following conditions that the whole of my lands be appraised by four disinterested free holders which shall be appointed by my wife Sinthy Hussey and my son Archibald Hussey with the five to share and share alike in the whole of my lands and said four appraisers shall first be sworn and then to go on land and appraise it to the best of their knowledge and if they should find that the appraised value exceeds the five shares which is five twelvth of my whole estate it is my will and desire that my beloved wife share and share alike with the rest of my heirs she taking one twelvth part of my whole estate after my debts are paid and all charges and expenses incurred by executors herein after appointed and the overplus if will be any over and above their expectations five shares it is my will that my wife Sinthy Hussey and son Archibald Hussey with Sam Hussey John Anderson Hussey and Lewis Gregory Hussey do pay it over to my executrix in a reasonable time for the use and benefit of those left of my heirs; Caroline Norton, Leah Lee, Lincy Lane, Sinthy Hussey, Elizabeth Hussey, Christian Hussey, Margret Ellen Hussey to which no land has been given within a reasonable time after the expiration of the time as below my will shall state. I the said Robert Hussey do herein constitute and appoint my beloved wife Sinthy Hussey my executrix of this my last will and testament and it is my will and desire that she at my death do take my whole business in charge and manage it to the best of her ability pay all my first debts and funeral expenses and it is my will and desire that she use the land and the stock for the use of my estate for twelve years free of charge and at the expiration of twelve years it is my will that she advertise and sell all my formal estate after paying all debts made by her for the use of my estate and carrying into effect this my last will and testament the balance to be equally divided with the overplus in land amongst the other eleven heirs as above named above. Signed sealed and delivered by the said Robert Hussey to be his last will and testament in the presence of us who have hereunto our? names and in the presence of the testator on the twenty third day of June One thousand eight hundred and fifty eight. B Wheeler ordinary of said district Isham Watson and Stephen Blackman personally appeared & make oath that they were personally present & saw the within named Robert Hussey signed, seal, publish pronounce and declared within instrument of writing to be and contain his last will & testament and that the said Testator was then of sound disposing mind & memory to the best of these deponents knowledge & belief and that Stephen together with themselves subscribed their names as witnesses then to thereto of the Testator & at his request.
