Thomas http://www.genrecords.net/emailregistry/vols/00016.html#0003785 April 14, 2010, 11:51 pm Source: Estates, Roll 2391, Marion County Sc Written: March 26, 1892 Recorded: October 5, 1899 South Carolina Marion County Last Will & Testament of Rebecca Hamilton In the name of God Amen: I Rebecca Hamilton wife of Arthur Hamilton, in the County of Marion and State of South Carolina, being possessed of property in my own right and being of sound and disposing mind and memory, do make and publish this my last will and testament, hereby revoking all former wills by me at any time heretofore made. And as to my worldly estate, and all the property, real, personal, or mixed of which I shall die seized and possessed, or to which I shall be entitled at the time of my decease, I divide, devise, bequeath and dispose of in the manner following to wit My will is that all my just debts and funeral expenses shall by my executors hereinafter named, be paid out of my estate as soon after my decease as shall by them be found convenient. Item. I give, devise and bequeath to my beloved husband, Arthur Hamilton all my property whether real, personal or mixed to have and to hold for and during the term of his natural life Item. And after the decease of my said husband, it is my will and desire, that all my said property, real, personal or mixed, shall be my executors be equally divided between my beloved daughters Mary Jane Martin and Ada Hursey. The real estate shall be divided between my said daughters as follows. My lands on the East side of Wolf branch shall be equally divided by a line running East & West, and also my land lying on the West side of said branch shall be equally divided a line running East & West. My daughter Mary Jane Martin to have the northern halves of each piece, and my daughter Ada Hursey to have the Southern halves of said pieces of land. And lastly I do nominate and appoint my sons in law W.T. Martin and L.G. Hursey to be the executors of this my last will and testament. In witness whereof I the said Rebecca Hamilton, have to this my last will and testament, consisting of two pages, subscribed my name and affixed my seal, this 26th day of March A.D. 1892. Personally appeared before me Whitton Martin one of the subscribing witnesses to the foregoing instrument of writing, who made oath on the Holy Evangelists of Almighty God that he saw Rebecca Hamilton sign, seal, publish, pronounce, and declare the same to be her last will and Testament; that she was then of sound and disposing mind, memory and understanding, to the best of deponent’s knowledge and belief; and deponent, together with A.P. Bridgman and Mollie Martin signed their names thereto as witnesses at her request in her presence and in the presence of each other: at the same time qualified W.T. Martin as Executor therein named. Given under my hand this 5th day of October in the year of our Lord one thousand eight hundred and Ninety nine and in the one hundred and 24th year of American Independence. P.B. Martin do solemly swear that this writing contains the true last will of the within named Rebecca Hamilton deceased, so far as I know or believe: and that I will well and truly execute the same by paying first the debts, and then the legacies contained in the said will, so far as her goods and chattels will thereunder extend and the law charge me, and that I will make a true and perfect inventory of all such goods and chattels: So help me God.
