Smith State of South Carolina Oconee County In the name of God Amen; I, J. Baylus Marett of the above county and state being of sound mind and memory and knowing the uncertainty of this transitory life, do make, publish and declare the following to be my last will and testament. I am revoking all former and previous Wills and codicils: 1st After my death I desire that my body be decently through planning be buried and a marble slab to be erected at my grave, but not expensive, all my debts be paid and discharged as soon after my death as the some can will be done, first out of my personal estate if sufficient if not then out of my real estate. 2nd To my beloved wife Mrs. E. C. Marett I desire set apart for her during her natural life or widowhood all the Real estate I die said in possession of, also all of my personal estate except one bed comforter and two trunks also one side board which is to be her own, and to be used on disposal of an she desires. I also expect the real estate and personal property sufficient to pay all of my debts and the some to be sold on disposal of an --- ------ often declared. It being my desire and I so direct that my wife E. C. Marett is first after my debts are paid, is to have a comfortable support during her time of widowhood out of my estate so far as it goes. 3rd I give devise and direct that all the rest and residence of my property both real and personal in mixed of every description ----- or kind which has not been used in the support and maintenance of my wife in widowhood and the payments of my debts at her death be sold and divided equally among my brothers and half brothers, sisters and half sisters so that all shall share and share alike, so that the child or children of a deceased parent to take to themselves the father or mothers share of my estate, my living brother are S. H. Marett, W. H. Marett ( Augustus, TX), and E. P. Marett and my sister Mrs. J. C. Harris, my living half sister Mrs. N. J. Morgan and my living half brother is Handy Marett. My deceased brother is T. M. Marett, and his surviving children now are Sloan Marett, T. M. Marett, and Miss Lou Marett who I desire to take to themselves equally their fathers share of my estate. 4th I nominate and appoint as my Executors J. R. Earle of Walhalla, SC and Rev. A. P. Marett of Westminster, SC and in case neither can serve or refuse I appoint some other person I giving to them and each of them the sole right for me and of my name, to have the full management of my estate, giving them the right at private or public sale to sell any of my personal property in Real estate and the right to make ----- there to, the same as if I was personally present, to have the right to -------- in action real estate and to do each and every other act in order to carry out the provisions of this will. This being my desire for my Executors to manage my estate and look after the interest of wife E. C. Marett. If my Executors at any time before the death of my wife decide it best to sell any part in all of my real estate they can do so. 5th I desire that the funeral and burying of my wife E. C. Marett be paid out of my estate before any division. By my hand and seal This October 24th 1906 J. Baylus Marett Mr. L. L. Jarrard at the request of J. B.
