Who lately died intestate, respectfully Showeth that Said Laban MAULDIN died Siezed and possessed of an Estate both Real and personal, that your petitioner is administrator of the personal Estate of Said deceased, which will be closed up in due course of administration and it is believed that Said personal estate will be Sufficient to pay the debts in which said decsd stood obliged but in the event it should prove insufficent your petitioner prays that such deficiency if any May be paid out of the proceedings of his real Estate. Your Petitioner prays that the Real Estate of Said deceased “Viz” one tract of land Situate in Pickens and Anderson Counties on Waters of Brushy Creek adjoining lands of Wm PHILIPS, Elizabeth WILLIAMS and others containing ninety acres more, or less; be sold , for Part____ & C The Heirs at law and distributees of said decsd, are. Mary MAULDIN his Widow who will be entitled to one Sixth part of the proceeds in lieu of Dower as the tract is not Susceptable of division & a large portion or all the proceeds May be required for payment of debts. Osborn NALLEY & wife Elizabeth, Wm JONES & wife Malinda, Thos. M HAMBY & wife Malissa, Mary MAULDIN, Nancy MAULDIN, John MAULDIN, John NORRIS & wife Candis and your Petitioner whom are all Survivors and reside in this county, and Bird MARTIN & wife Caroline who reside in the State of Florida, Vardry MAULDIN, & Harvey SMITH & wife Adaline whom resides in the State of Georgia. Your Petitioner prays that the usual Rule May be published directed to said absent heirs, and Summons in Partition be issued out of your Honorable Court directed to the above named heirs residing in this State commanding them on a day Certain to be and appear in your Honorable Court & Show Cause if any they can why a Sale & partition of the Real Estate of Said decsd, May not be had as prayed for, and to do and abide whatever your Honorable court May do in the premises, & your petitioner will ever pray & C August 2nd 1869 Holcombe Pro. South Carolina Mabry MAULDIN Pickens County vs Vardy MAULDIN Et al on due Examination it is ordered and decreed that the lands described in the Summons in Partition in this case be Sold by the Sheriff of Pickens County on the first Monday in October next on a credit of Twelve months with intrest from date of Sale, the purchacer to giving bond with good Security and a mortgage of the premises to the judge of Probate for the payment of the purchase money.
