Advertised for Absent Legatees to appear on or before 1st Monday of June next Ordered to be sold by the sheriff on the 1 Monday of Dec & postponed for council till the 6th of January 1840 and then the sale was forbidden by Mrs. Celia Hamilton. I therefore further postponed the sale hoping that the parties would compromise at March Court; this the applicant Kirkpatrick utterly refused to do, and urged the sale. Applicants Petition and 2d applicant. To the Court of Ordinary for Pickens District, So Carolina. The undersigned one of the Heirs of David Hamilton in right of my wife Mary petitions your court for the sale of 108 acres of land devised to his Grandson by the said deceased who died before the said Devisee, and consequently the will could not take effect. The Prayer of your Petitioner therefore is that the said Tract of 108 acres of land be sold by the Ordinary as soon as practicable on a credit until the 25th of December next Given under my hand the 16th March 1840. signed by Andrew W.
