David Hamilton Estate of David Hamilton Box #89

I David Hamilton being far advanced in my time of life and frail but
of sound mind and memory etc. I give to my wife Jane two beds and
their furniture, the Plantation and house on which I live, and one
half of the amount of the sale of my property.  I give to my son
Andrew Hamilton one hundred and eight acres on which he now lives for
his support but not subject to his disposal or debts, but to be the
property of my grandson Alexander Hamilton, his son in fee simple.
I give to my two grnddaughters Margaret and Jane Hamilton a tract of
land on Golden Creek of 38 acres. It is my will that my personal
property be sold on twelve months credit, except my Man Cegar, not
to be sold but to live with my children, not as a slave. Also my
woman Malinda to stay with my wife during her life time, she also
may choose the one of my children she wishes to live with, not as
a slave. At the death of my wife the Plantation to be sold and divided
ad, one third to my daughter Margaret Prater and one third to Mary
Kirkpatrict, the remaining third to my granddaughters Margaret and
Jane Hamilton. After my debts are paid the balance as thirty dollars
to each of my children, Elizabeth Parsons, Andrew Hamilton, David
L. Hamilton, Mary Kirkpatrict, Margaret Prater and Bersheba Fraser.
I appoint Major Andrew Hamilton, Col. David k. Hamilton, Thomas G.
Boggs, my step-son as Executors. Dated 20 Feb. 1830. Wit: J.L. McCann
Fielding Fennell, Rev. McCann. D. Chamblin.

The forgoing last will and testament of David Hamilton was not
proven by a subscribing Witness as is usual, they being absent from
the State.  Proven on oath of Col. David K. Hamilton, one of the
executors, James H. Dendy, Ord, Proven 7 Nov. 1837
Legatees paid on 19 Jan. 1839. Janett Parson and wife Margaret.
Andrew W. Kirkpatrict. Samuel Fraser, Shelby Bates, Jane P. Hamilton,
David A. Hamilton.
