Deeds of Spartanburg County, South Carolina Deed Book K, pages 471-473 James Terrell to John Locke No 393 24th February 1807 This Indenture made this twenty sixth day of January in the Year of our Lord one thousand Seven hundred and ninety two and Seventeenth Year of the Sovereignty and independance of the United States of America Between James Terrell and Frances Terrell his wife of Spartanburgh District and State of South Carolina of the one part and John Lock of Union County and State aforesaid of the other part Witnesseth that the said James Terrell and Frances Terrell his wife for and inconsideration of the sum of one hundred pounds lawfull money to them in hand well and duly paid by the said John Lock at and before the Sealing and delivery of these presents the receipt and payment whereof is hereby acknowledged he the said James Terrell and his wife hath bargained sold _______ conveyed and confirmed with the said John Lock to his heirs and assigns forever all that message or tract of Land lying and being in the County and State Aforesaid on the south forke of Gelkies Creeke assertained by courses and distances as follows to wit beginning at a white oake running thence North 60 East 32 Chains to a hickory thence S 43 fifteen Chains and 50 links to a Chesnut thence E twenty 20 chains to a red oake thence N 40 E 17 Chains to a post oake thence N 30 W 33 Chains to a white oake thence S 60 E 14 Chains to a Stake thence N11 Chains to a red oake thence West 60 Chains to a Chesnut thence S 30 W 38 Chains to a red oake thence S 28 E 51 Chains to the beginning Containing 496 Originally Granted to the said James Terrell by his Excellency the Governor of South Carolina with their appertenences situate lying and being as aforesaid with this and every of their wrights member appertenences whatsoever and the reversion and reversions remainder and remainders all and Singular the houses improvements orchards and premises hereby Granted or intended to be granted and every part and parcel thereof all rents issues profits claims or demands Whatsoever of him the Said James Terrell his wife ____ of the said premises or tract of land containing 496 acres as aforesaid and every of the premises unto the said John Lock and to his heirs and assigns forever and the said James Terrell doth hearby for himself his heirs and assigns doth covenant promise and agree to and with the said John Lock his heirs and assigns in manner as follows that is to say he the said James Terrell now is and until the Execution of these presents Shall Stand Seized of a good sure and perfect and indefeasible estate of interance in all the aforesaid tract of plantation of land containing 496 acres as aforesaid with the wrights members appurtenances Whatsoever and lastly after the Execution of these presents that the said John Lock his heirs and assigns shall and may from time to all times hereafter peaceably and quietly have hold use occupy and enjoy the said plantation or tract of land containing as Aforesaid without any manner of trouble hindrance molestation or denial of him the said James Terrell and Frances his wife their heirs and assigns of all and every of them and every other person or persons and the said James Terrell and Frances his wife from themselves their heirs and Executors Administrators or Assigns from all and Every of them and every other person or persons will Warrant and forever defend the aforesaid Premises In Witness Whereof the said James Terrell and Frances Terrell his wife hath hearunto Set their hands and Seals affixed their Seals the day and Date above Written Signed Sealed and delivered in the presence of Powers Lamkin Hezekeah Terrell John (his X mark) Border Signed: James Terrell (Seal) Frances (her X mark) Terrell (Seal) South Carolina Spartanburgh District Personally came John Border before me and duly made oath that he saw James Terrell and Assign his deed of Conveyance and also the said wife ____ to John Locke for the use and purposes within mentioned and at the same time he saw Powell Lamkin and Hezekiah Terrell sign their names as Witnesses with himself As the Same Sworn to and Subscribed to this 23d day of February 1807.
