Contributed to The USGenWeb Archives by: Brian Nilsson (BHNilsson@aol.com) 8 May 1999 ---------------------------------------- South Carolina Department of Archives and History Spartanburg Wills Will of John Brewton I John Brewton of the State of South Carolina Spartanburg District being in a low state of health but of sound and disposing mind and memory but calling to mind the uncertainty of life and desirous of disposing of what Estate it has pleased God to bless me with I do hereby make and constitute this my last will and testament in the following manner: I leave to my daughter Eliza. J. Brewton a negro girl named Harriet, one horse worth eighty dollars, saddle and bridle, one bureau, two feather beds and bed clothing and two bedsteads, one cow and calf of her own choice, earthen and potware in proportion as my other children have received and one hundred dollars, which makes her equal with my other daughters. I have given to my son Silas Brewton one thousand dollars and my will is that he have one cow and calf of his choice after my daughter Eliza has chosen and one sow and pigs desiring, that this should make him only equal in the distribution made by me to my daughters. The advancements made by me to my son Eber Brewton is Eight hundred dollars over and above what I have given to my other children which I wish to stand good against him as that much of my estate accounted to him or his children by the administrator of my estate. My will and desire is that the administrator of my estate retain in his hands at interest a sufficient of the proceeds of the sales of my estate for a comfortable support for my sister Polly Grace if her funds should fail before her death unless there can be satisfactory arrangements made amongst my children with her for her support, then in that case the money to be divided as the balance of my estate, and if there should be funds left after her death the same to be equally divided between my lawful heirs, my Will and desire is that my lands shall be surveyed and laid off into such lots as may be thought best and most advantageous to the value of my estate and on such credits as my son Silas Brewton and sons in law P. M. Waters, Simpson Drummond, and R. W. Foster may agree and think best, or by the whole in one tract if they agree or think best to be sold by the administrator of my estate, and also all of my personal estate to be sold. Lastly my will is that after the payment of all my just debts the remainder to be equally divided between Mary Waters, Silas Brewton, Malinda Drummond, Mahalah Hamilton, Elizabeth Ann Foster, and Eliza. J. Brewton until they have received the sum of eight hundred dollars each, and then my son Eber Brewtons children Elizabeth Brewton, Mary Louisa Brewton and Eber Brewton, to receive their Father's proportion able share with the above named children until it is equally divided amongst them. In testimony whereof, I have hereunto set my hand and affixed my seal, the 7th day of April 1849, in presence of us, Simeon Brewton, David Pearson, Willis L. Brewton. John Brewton (L. S.)
