Persons or organizations desiring to use this material for non-commercial purposes, MUST obtain the written consent of the contributor, OR the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ---------------------------------------- Contributed to The USGenWeb Archives by: Lorene Rambo 18 July 1998 ******************************************************************************************* Moses Quals/Qualls sells land to James Terrill Deeds of Union County, South Carolina Book A, page 212 This Indenture made the seventeenth day of December in the year of Our Lord One thousand seven hundred and Eighty five and the ninth year of the Independence of the United States of America Between Moses Qualls of Union County and State of South Carolina Miller of the One part, and James Terrill of the County and State of South Carolina planter of the Other part.  Witnesseth that the said Moses Qualls for and in Consideration of the sum of One hundred and fifty pounds lawful money of the State aforesaid to him in hand paid by the said James Terrell at and before the Sealing and Delivery of these presents the Receipt Whereof is hereby acknowledged he the said Moses Qualls hath Bargained Sold and by these presents doth Bargain Sell Alien Convey and Confirm unto the said James Terrell his Heirs and assigns for Ever, all the Right Title Claim Interest and Demand whatsoever of him the said Moses Qualls to a Certain Tract of Land laying and being in the County of Union and State aforesaid Containing One hundred and fifty acres.  Originally Granted to Manen Gore by his Excellency the Governor of North Carolina by a Patent Bearing date the twentysecond day of December in the year of Our Lord One thousand seven and sixty Eight and Conveyed by the said Manen Gore to Hugh Quin and from the said Quin to the said Moses Qualls ascertained by Courses and Distances as follows (viz) Beginning at a Chesnut and Hickory on the North side of  Broad River on the side of the Island and Runs thence Crossing the Island 60 W 155 Poles to a Stake in the River by the lower end of the Island, thence to the Beginning now this Indenture WITNESSETH that the said Moses Qualls hath Bargained Sold and Conveyed and Confirmed unto the said James Terrell now in Actual possession being by Virtue of a Statue for Transferring Uses into possession, and to his Heirs and assigns for ever, all that Tract of Land of One hundred and fifty acres Situate as aforesaid together with all and Singular the houses Orchards, Buildings Improvements, woods, ways Water Water Courses Rents passages, profits and Advantages thereunto belonging or in any wise appertaining and the Reversion and Reversions Remainder and Remainders and every part and parcel thereof and all the Estate Right Title Interest Use and Possession Property Claim and Demand whatsoever of him the said Moses Qualls of into or out of the same premises, and every part thereof To Have Hold the said plantation or Tract of Land Containing One hundred and fifty Acres Originally Granted as aforesaid, and every the premises unto the said James Terrell his Heirs and Assigns in manner as follows, that is to Say he the said Moses Qualls now is and untill the Execution of these presents shall stand Seized of a Good sure perfect and Indefeasible Estate of Inheritance in fee Simple and in all the aforesaid plantation or Tract of Land Containing One hundred and fifty acres with the Rights Members Appurtenances whatso Ever without any manner of Condition Trust Mortgage Judgment Execution or Incumbrance whatsoever to alter Change or determine the same, and also the said James Terrill his Heirs and assigns Shall and may from time to time and at all times hereafter peaceably and Quietly have hold use Occupy and Enjoy the said plantation of One hundred Acres of Land without any manner of Trouble Hindrance Molestation Interruption or Denial of him the said Moses Qualls his Heirs and Assigns of all and every of them, and every Other person or persons, and lastly the said Moses Qualls for himself his Heirs Executors and Administrators the said plantation of One hundred and fifty Acres of Land with the premises Appurtenances to the said James Terrill his Heirs and Assigns, and all and every other person or persons whatsoever shall and will Warrant and forever defend by these presents, IN WITNESS my hand hereunto set and Seal the day and year above Written.
