Persons or organizations desiring to use this material for non-commercial purposes, MUST obtain the written consent of the contributor, OR the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ---------------------------------------- Contributed to The USGenWeb Archives by: Lorene Rambo 18 July 1998 ******************************************************************************************* James Terrell sells land to Moses Quals Deeds of Union County, South Carolina Book A, page 80 This Indenture made the seventeenth day of December in the year of Our Lord One thousand seven hundred and Eighty five and in the ninth year of the Independency of the United States Between James Terrell of Union County and State of South Carolina of the One part and Moses Quals of the same place of the Other part WITNESSETH that the said James Terrell for an Consideration of the sum of three hundred pounds lawfull money of the State aforesaid to him in hand paid by the said Moses Quals at and before the Ensealing and delivery of these presents the Receipt whereof is hereby acknowledged Hath Granted Bargained Sold and by these presents doth Bargain Sell Allien Convey and Confirm unto the said Moses Quals his Heirs and assigns for ever all the Right Title Claim or Interest and Demand Whatsoever of him the said James Terrell To a Certain Tract of land laying on Broad River in Union County Containing One hundred and thirty four Acres Originally Granted to the said James Terrel by a patent bearing date the twentyfirst day of January one thousand seven hundred and eightyfive ascertained by Courses and distance as follows viz Beginning at a black Gum on the Island on the Bank of the River thence So. 45 W 37.73 to a Red Oak thence N. 43 W. 35.75 to a Spanish Oak thence N 45 E 37.75 to a Stake thence to the Beginning.  NOW THIS INDENTURE Witnesseth that the said James Terrell hath Bargained Sold Conveyed and Confirmed unto the said Moses Quals now in his Actual Possession being by virtue of a Statute for transferring Uses into possession and to his Heirs and Assigns for ever all that tract of Land Containing one hundred and thirty four Acres Together with all and Singular the houses orchards Building, Improvements Woods Ways Waters Water Courses Rents Issue Profits and Advantages thereunto belonging or in any wise Appurtaining and the Reversion and Reversions Remainder and Remainders, and every part and parcel thereof, and all the estate, Right Title Interest Use and possession property Claim and demand Whatsoever of him the said James Terrell of into or out of the Land premises and every part thereof, to have hold the said plantation or Tract of Land Containing One hundred and thirty four Acres Originally Granted as aforesaid and every the premises unto the said Moses Quals his Heirs or Assigns and the said James Terrell doth hereby for himself his Heirs Executors Administrators or assigns doth Covenant and promise and Agree to and with the said Moses Quals his Heirs and Assigns in Manner and form as follows that is to say he the said James Terrell now is and untill the Execution of these presents shall stand Seized of a Good sure perfect and Indefeasible Estate of Inheritance in fee Simple of and in all the aforesaid plantation or tract of Land Containing one hundred thirty four acres with the Rights Members Appurtenances without any manner of Condition Trust or Mortgage Judgment Execution or incumbrance whatso ever to alter Change or determine the same And Also the same Moses Quals his Heirs and Assigns Shall and may from time to time and at all times hereafter peaceably and Quietly have hold use Occupy and Enjoy the said plantation of One hundred and thirtyfour Acres of Land without any manner of trouble, hindrance, Molestation, Interruption or denial of the said James Terrell his Heirs and Assigns of all and every of them and every Other person or persons and lastly the said James Terrell for himself his Heirs Executors administrators the said plantation of One hundred and thirty four Acres with the premises appurtenances unto the said Moses Quals his Heirs and Assigns Against him the said James Terrel his Heirs and Assigns and all and every other person or persons whatsoever shall and will warrant and for ever defend by these presents IN WITNESS my hand hereunto set and Seal the day and year above written.
