ANDERSON COUNTY, TN - WILLS - Larkin Hackworth, 19 Apr 1889 ----¤¤¤---- Transcribed from SAMPUBCO copy by Maris O'Rourke Anderson County, Tennessee Will Book Vol. TN 1-5-96 (pages 96-99) LARKIN HACKWORTH - Last Will and Testament In the name of God Amen: I Larkin Hackworth of Anderson County, Tennessee being now of sound mind and memory, do make this my last Will & Testament hereby annulling and making void all other Wills by me at any time made. 1st. I direct my Executors hereinafter named to pay my funeral Expenses out of any money that I may die seized or possessed of or, if I leave no money on hand, then I direct that my said funeral Expenses be paid out of the first money that comes into the hands of my Executors. 2nd. It is my will that my just debts be paid as soon after my death as practicable out of any money or effects that I may die seized or possessed of. 3rd .I hereby will and bequeath that my real estate be divided as follows: viz: I will and bequeath to my son R. C. Hackworth what is knows as Lot No. 1 of the division made by M. D. F. Butler. Said Lot beginning on a stake and bush on a branch at the foot of Walden's Ridge, W. J. Hoskins corner, then running with the old line N 46 ¾ E 40 poles to a stake and pointers, then S 65 ¾ E 111 poles to a white oak and ash then 33 ½ E 100 poles to a stake in the back line on the long hollow branch, then with said hollow to the lane, then with the lane to the Valley Rd crossing the road to the beginning. Containing fifty five acres more or less. I also desire that my son R. C. Hackworth have the right and privilege of having all of his grain ground free of toll when possible at my mill. 4th. I will and bequeath to my son C. S. Hackworth Lot No.2 of my land. Beginning on a stake corner of Lot No. 1 on the old line near the foot of Walden's Ridge then running with the old line N 46 ½ E64 poles to a stake and pointers on the North Bank of the road, then S 46 ½ E 211 poles to a stake and pointers in the south line of the 200 acre tract, then with the same S 461/2 W 44 poles to the corner of Lot No.1 then with the line of the same N 33 West 100 poles to a white oak and ash , corner of Lot No. 1 then with the line of same N65 ¾ W 111 poles to the beginning. Containing fifty five acres more or less. 5th. I will and bequeath to the heirs of my son John Hackworth deceased, viz Charles Hackworth, Jesse Hackworth, and Lacy Hackworth four hundred and fifty ($450.00) dollars to be paid out of my personal Estate and to be equally divided between them. 6th. I also will and bequeath to my son C. S. Hackworth one third of my mill property. 7th. I also will and bequeath to my son M. F. Hackworth two thirds of my said mill property. 8th. I will and bequeath to my son M.F. Hackworth Lot No.4 of my land. Beginning on a chestnut near the foot of Walden's Ridge corner of the old tract of Lot No.3 , then running with the line of the 175 acre tract then N 40 ¾ East 60 poles to a stake gum and sourwood black oak pointers, then S38 E with the plank fence 35 poles to a stake on the bank of a branch, three feet East of poplar pointers then running with the meanders of the branch when reduced to a straight line will be S56-16 poles to a beach on the South bank of the mill race, then up the South side of the race to the mill dam, then N50 E17 poles to a beach, then N45 E40 poles to a beach and pointers near the fence, then S39 ¾ E15 poles to a stake and hickory pointers, then due East 40 poles to a stake in the old line, then about S35 W110 poles to a stake and maple at the old white oak corner, then with the line of Lot No.3. North 59 ½ W110 poles to the beginning. Containing fifty five acres be the same more or less, including the houses and buildings where I now live, Lot No. 3 not being herein described but belongs to my son M. F. Hackworth by purchase and for the description of the same see deed from Larkin Hackworth and wife to M.F. Hackworth and the proceeds of the same is heretofore bequeathed to the children of my son John H. Hackworth and amounting to the sum of four hundred and fifty dollars. 9th. I will and bequeath to my son M.F. Hackworth thirty dollars in money to come out of said Lot No.3 to make him equal with the balance of my children. 10th. I have given or deducted out of the price of the farm sold to L.H. Fields two hundred dollars, this is what I will and bequeath to his children by his first wife who was my daughter Martha J. Fields and this to be in full as her part of my estate. 11th. I will and bequeath to my daughter Ruth A. Hoskins five dollars to be paid out of my personal Estate. 12th. I further will and bequeath to my son M. F. Hackworth one acre of land at the mill site to be used as a yard and for general mill purposes. 13th. I nominate and appoint my sons W. T. Hackworth and C. S. Hackworth as my Executors to this my last Will and Testament. In Testimony whereof I have hereunto set my hand and seal on the 19th April 1889. Hoskins The foregoing last Will and Testament of Larkin Hackworth was signed by the Testator in our presence, and we witnessed the same at his request and in the presence of each other. Jasper Hoskins James England J. W. Hoskins The foregoing instrument purporting to be the last Will of Larkin Hackworth and was produced in open court by M. F. Hackworth and Jasper Hoskins and J. W. Hoskins two of the subscribing witnesses to said Will appeared in open court and proved the same according to law after being first sworn. It is therefore ordered by the court that said Will be admitted to probate and the same be recorded in the book of Wills this July 6th 1896. R.N.
