Erwin and Company to James Erwin for 17,205 acres This indenture made the Twenty fourth day of August in the year of our Lord one thousand Eight Hundred and Eighteen between George Hargrove, John McKenna, William Sims and Barna McKenna, Assignees of A. Erwin, A. Erwin Grace and Company and A. Erwin and Company by their Attorney Andrew Erwin of the City of Augusta in the State of Georgia of the one part and James Erwin of the County of Bedford in the State of Tennessee of the other part. Witnesseth that for and in consideration of the sum of Nine Thousand Five Hundred and Forty Five dollars to them in hand paid by the said James Erwin he being the highest bidder at a publick sale authorized by the said Assignees and in the presence of one of us (viz J. McKenna) at the Brick house near the Three Forks of Duck River this day the receipt of which is whereof acknowledged Hath given, granted, bargained, sold, conveyed and confirmed unto the said James Erwin his heirs and assigns Forever the following Tracts and Parcels of Land Situate lying and being in the County of Bedford Aforesaid Containing in all Seventeen Thousand Two hundred and five acres more or less (viz) One Tract called Walls Old Place Three hundred and Ninety Acres on the South Fork of Duck River, adjoining Walls Old Place on the South One Tract called Riggs Old Place Two Hundred and Sixty Two acres more or less adjoining A. Hords in all One thousand acres more or less One Tract where Samuel Pierce now lives on McBride's Creek Five hundred acres more or less One Tract adjoining the above called Matt Martin's Old Place Two hundred acres Three Tracts adjoining the widdow Patton's and John Nall's Old Place on Noah's Fork including where Jesse Hall, Mrs. Crayton, and Mrs. McMichael now lives Five hundred and fifty acres more or less One Tract called Elam's Bottom adjoining Hooper's Two hundred acres more or less including where Hooper now lives and lands adjoining Captain Martin Entered by A.E. [Andrew Erwin] at Shelbyville Three Tracts contained in Grant No 220 including where James and John Walker and Slaton now lives and Walker Mill being all the balance of said Grant not heretofore sold Ten hundred and ten acres more or less One Tract near the head of the Garrison Fork Three thousand acres more or less a part of which interferes with Joseph Branches Grant the Entire Balance of Grants No. 224 and 232 One Tract adjoining Freeman Burrow on Thompson's Creek Eighty five acres being all the lands sold at the Brick House at Publick sale this day and also for and in consideration of the sum of Five Hundred dollars to us in hand paid by the said James Erwin the receipt whereof is hereby acknowledged hath at private sale given granted bargained sold conveyed and confirmed unto the said James Erwin his heirs and assigns forever the following tracts and parcels of Land Situate lying and being in Bedford County aforesaid One Tract on the head of Wartrace Fork of Duck River being the entire balance of Grant No. 219 and interferes with Branch's Claim Fifteen hundred acres more or less One Tract adjoining Major John Sutton's One hundred acres more or less Together with all the rights and claims we the assignees of A. Erwin, A. Erwin Grace and Company and A. Erwin and Company have to any lands in the said County of Bedford by Virtue of an assignment by Andrew Erwin Sr. to a sale at Augusta March the Twenty Sixth One Thousand Eight Hundred and Eighteen. To have and to hold the aforesaid lands and bargained Premises With all and Singular the rights and Appurtenances to the only Proper use and behoof of the said James Erwin his heirs and assigns forever and the said Andrew Erwin as Attorney aforesaid Warrent and defend the aforesaid lands and bargained Premises to the said James Erwin his heirs Executors Administrators and Assigns claiming by through or under them or Either of them and no further.
