McGimsey, Bedford County, TN, 17 February 1820 Surnames: Hess, McGimsey, Payne Bedford Co., TN, deed book M, pp. 115-116: 115) Wm R Hess John W McGimsey Mortgage Know all men by these by these that I William R Hess of the County of Bedford and State of Tennessee Having on the fourteenth day of October last Mortgaged to John W McGimsey a Negro Girl Named Isabel for the Sum of Two hundred Dollars and the Said McGimpsy having this day entered as Surety for the said William R. Hess in a Note for forty nine dollars Given to thomas C Moore due the first day of Sept Eighteen hundred and Twenty Now therefore If the Said William R for and in Consideration of the Sum above mentioned do Sell Transfer and deliver unto the Said John W McGimsey and his heirs forever the said Negro Slave Isabel aged about Sixteen Years and I do further Warrant the Title of the Said Negro Slave Isabel to the Said McGimsey his heirs &c forever and that she is Sound healthy and Sensable Witness my hand and Seal this 17th day of February 1820 Provided nevertheless that if the said Wm R Will Well and Truly pay the said note of ["Fifty" lined out] forty nine dollars when the Same Comes due and thereby secures the said John W McGimsey [--pg. 116--] From paying the same or any part thereof and Will pay to said McGimsey the said sum of Two hundred Dollars on or before the 17th day of August 1821 or in Case the said W R Hess Should fail to pay said note of forty nine dollars to said Moore whareby the said McGimsey Will have the same to pay then if the said W R Hess Will Well And Truly pay to said John McGemsy on or before the said 17th day of August 1821 the sum of Two hundred dollars also the said Sum of forty nine dollars this obligation or Mortgage to be Void & of no effect otherwise to remain in full force & virtue & to operate as & absolute bill of Sale for said Negro Girl Given under my hand & Seal the day above Written Signed Sealed & Delivered ..........
