Meadows To Joseph Couch Deed in Trust This Indenture made this 14th day of October in the year of our Lord eighteen hundred and thirty seven, Between Ephraim G. Meadows of the County of Bedford and State of Tennessee of the one part, and Joseph Couch of said County and State of the other part. Witnesseth that whereas the said Ephraim G. Meadows hath executed his note to Joseph M. Burnett for the sum of three hundred and five dollars payable, the 25th of December next and dated this day in consideration of a Tract of land, sold him by the said Burnett on which said note the said Joseph Couch is the Security of the said Ephraim G. Meadows for the payment thereof, and the said Ephraim G. Meadows being desirous to indemnify the said Couch, against the payment of said note, Now therefore in consideration of the premises, and for the further consideration of one dollar, taken in hand paid the receipt whereof is hereby acknowledged, the said Ephraim G. Meadows hath bargained, sold conveyed and delivered, and doth by these presents bargain, sell, convey and deliver the said, Joseph Couch all the right, title, claim and Interest that the said Ephraim G. Meadows has in and to a distributive share in the Estate of his father Michael Meadows deceased, consisting of negroes, also one Tract of land lying in said County of Bedford on the waters of the North fork of Duck River, Containing Fifty acres more or less being fifty acres on the south side of a tract of one hundred acres of land, sold and conveyed by Joseph M. Burnett to Henderson Meadows, and Ephraim G. Meadows, by deed dated the 23rd day of December 1835, and adjoining the land Enoch Head on the South which said land is more particularly described, by said Deed (reference being had thereto) To have and To hold said distributive Share of the said Estate of the said Michael Meadows deceased and the said Tract of land unto the said Joseph Couch his heirs and assigns forever. And the said Ephraim G. Meadows doth by these presents Covenant and bind himself his heirs and representatives to warrant and forever defend the title to the said distributive share and said Tract of fifty Acres of land and every part thereof to the said Joseph Couch his heirs and assigns, against the lawfull (sic) Claim of all persons whatever, But this deed is made for the following uses, and trusts and for no other purpose that is to say that if the said Ephraim G. Meadows shall well and truly pay off and discharge the aforesaid note for $305--payable to the said Burnett as aforesaid, on which said Couch is Security when the same falls due, or at that time Otherwise release the Couch from all liability on the same, then this deed of Trust to be void, and of no effect whatever, But should the said Joseph Couch be compelled to pay said note when due, then and in that event the said Joseph Couch is to hold absolutely as his property the said distributive share of the said Ephraim G. Meadows in the estate of the said Michael Meadows, deceased at the price and value of two hundred dollars to be deducted out of the aforesaid sum of $305--Interest & expenses thereon should the said Joseph Couch be compelled to pay the same. It is also understood and agreed that should the said Joseph Couch be compelled to pay the note Aforesaid, that for the purpose of paying the balance that he may pay on said Note, After deducting the Amount of the distributive share aforesaid, he may sell the Tract of fifty Acres of land herein conveyed either at private or public sale upon credit of twelve months, and the proceeds of said sale he shall apply first to the payment of the balance on the note due the said Burnett as aforesaid after deducting the distributive share aforesaid and the balance (if any) of said sale he shall pay over to the said Ephraim G. Meadows. In Witness whereof the said Ephraim G. Meadows has hereunto set his hand and affixed his seal the day and date first above written E.G. Meadows Signed and executed in presence of Thomas C. Whiteside Joseph M. Burnett State of Tennessee--Bedford County. Personally appeared before me William D. Orr Clerk of Bedford County Court, E.G.
