This Indenture made this Tenth day of
April in the year of Our Lord one Thousand Eight
hundred and twelve between James Patton & andrew Erwin
of the County of Buncombe and State of N Carolina of
The one part and Zedekeah Payne of the County
of Bedford and State of Tennessee of the other part
Witnesseth that for & in consideration of the Sum
of Seven Hundred & Twenty Three Dollars to us in hand
Paid by the Said Zedeah Payne the receipt whareof
is hereby Acknowledged Hath Granted bargained Sold
allien, Conveyed & Confirmed & do by these presents Grant
Bargain Sell allien Convey & Confirm unto the said
Zededeah Payne his heirs & assigns forever a Certain
Tract or Parcel of Land Situate lying & being in
The County of Bedford & on the Barron fork of Duck
river Beginning at W C Ballards Corner on the river
bank on a White Oake & beech thence South Thirty Six
poles to Ballards other Corner on a White Oake Thence East
One hundred & thirty two poles to two beeches & a Sugartree
Passing J Ewels Corner at Eighty poles thence North thirty degrees
West one hundred & Twenty poles to the middle of the South
fork of duck river thence up the river bank with the
meanders thareof North Sixty degrees East thirty Six pols
Thence North 30 [degrees] west one hundred & two pols to a beech &
[--pg. 260--] Ironwood in W. Carters line Thence west with his line Fifty
Six poles to a beech Dogwood & hornbeam Thence South
one Hundred & Sixty Eight poles to the Beginning
Containing by Calculation one Hundred & nineteen acres
be the Same more or Less To Have and to Hold
The aforesaid Tract of Land together with all & Singular
The rights profits emoluments hereditaments & Appurtenances
of in & to the Same belonging or in any wise appertaining
To the only proper use and behoof of him the said Zebediah
Payne his heirs & assigns forever & we the said James Patton
& Andrew Erwin for ourselves our heirs Executors administrators
& assigns do Covenant & agree to & with the said Zebediah
Payne his heirs & assigns that the before recited Land & bargained
premises we will warrant & forever defend against the right Title
Claim Interest or demand of all & every person or manner
of persons whatever In Witness whareof we the said
James Patton & Andrew Irwin have hereunto set our hands
And & affixed Our Seals the day & year first above
