Witnesseth that for and in consideration of the Sum of Twenty Six dollars and Twenty five cents In hand Paid by the said Kennedy to the said Ross before the sealing and delivery of these presents the said Ross do hereby Sell, Alien, Convey cut off and Confirm unto the said Kennedy his heirs and assigns forever a Certain Tract or Parcel of Land Containing Three Acres and Sixteen Poles and one half, be the same More or Less Situate Lying & being in the County aforesaid and on the Waters of Noah's fork of Duck River being part of a tract of 40 acres granted by the State of Tennessee to the said James Ross to Wit -- Beginning at a beech marked thus X about four poles West of where the South Boundary of said Grant crosses the Branch whereon the said Keneday now lives, thence North seventy poles to a stake in the North boundary of said Grant thence East six and one eighth Poles to the Conditional corner between said boundary and Timothy Teal thence south with said Teal's line to the stake and beech for the said deed of the same date of this thence to the Beginning. To Have and to Hold the aforesaid bargained Land and Premises to the only Proper use beingst of him the said Kennedy his heirs and assigns and the said Ross on his part doth hereby Covenant to and with the said Kennedy that he will Warrant and forever defend the above Described Land with all its appurtenances hereditaments and Profits against the Claim or Claims of all and every Person or Persons in Law or Equity Whatsoever to the only proper use and behoof of the said Kennedy his heirs and assigns forever. In Witness whereof the said James Ross hath hereunto set his hand and affixed his seal the day and year above Written.
