This file was contributed for use in the USGenWeb Archives by: Suzanne Haley nolefan1@mindspring.com ==================================================================== JOHN GILLESPIE, Blount Co, TN wills, April, 1839 I, John Gillespie, of the County of Blount and State of Tennessee, being very infirm of body and of precarious health and regarding the approach of death at no distant period as highly probable, but believing myself of sound and disposing mind and memory, and being desirous of settling and disposing of my world affairs and effects for the benefit of my family for whoom I deem it my duty as far as in my power to provide do by these presents for this purpose, hereby make and publish my last will and testament. 1st, I will and bequeath that my executors herein after named shall proceed as soon as convenient after my decease to collect all debts due my estate. 2nd, I will and bequeath that my said executors shall in convenient time sell at public sale the following personal property to wit, all my horse beast, but ... two yoke of oxen, one set of ...wheels also ...and two waggons. I also desire and will that my said executors sell either at public or private sale as they shall in their discretion deem more advisable at such time or times as they may think proper, my town lots in the town of Louisville and a small slip of land between said lots & Esgr. Saffell in said County and that they make title for the same to the purchaser or purchasers thereof and that said property real and personal be sold on a credit of 9 months or 1 year taking good security from the purchaser. 3rd, I will and bequeath after paying funeral and necessary expenses, ...that the proceeds of the debts that may be collected, and of said sales shall be applied to the satisfaction of all just debts against my estate and if not sufficient for that purpose, I will and bequeath that my said Executors shall sell any other real estate I may own in said County and apply as much of the proceeds thereof as may be necessary to the satisfaction of said ballance of debts. 4th. I will and bequeath that my negro boy Bob and my negro girl Juinny (??) remain unsold, subject to the entire management control and discretion of my wife JANE GILLESPIE for the benefit and support of my said wife and my minor children: MARTHA MILINDA GILLESPIE, WILLIAM PAXTON GILLESPIE, NANCY ELISABETH GILLESPIE, ROBERT DENNON (?) GILLESPIE, JOHN FINLEY GILLESPIE, LUCINDA JANE GILESPIE, WAUDEN(?) JEROME TATE GILLESPIE, and SARAH EMILY GILLESPIE until the youngest of said children surviving shall attain the age of 21 years or shall marry when I will and bequeath to my said wife Jane Gillespie if there being the absolute right and title to said girl JUINNY(?) if she be thus surviving, but if she be dead then I will and bequeath to my said wife the absolute rights and title to my said negro boy Bob. 5th. I will and bequeath that my negro children the issue of my said negro girl Juinny shall remain unsold subject to the control and direction of my said wife until they may be disposed of as herein after provided. 6th. I will and bequeath that my real estate until the same shall be sold if necessary, as herein before provided shall remain in possession of my said wife and children for their support or that any part or parts thereof shall in the discretion of said executors be rented or be leased. 7th. I will and devise of my real estate Exclusive of land and lots a ...estate...to my said wife to be assigned her as promised by law if she shall think proper to apply for the .... 8th. I will and devise of my real estate that may not be sold an equal portion to each of my children heirs herein before named ...to be assigned them respectively as they shall severally marry or arrive at full age. 9th, After the payment of my last debts as aforesaid I will and bequeath that all the residue of my personal property my slaves with their issue ...the proceeds of the sales of my real or personal estate shall be applied and used for the benefit and comfort of my wife and children aforesaid and that the same shall be advanced to my said children by my said wife, at such times and in such proportion as she may deem right and proper. I have felt it my duty to make the foregoing provision for the benefit of my wife and minor helpless children whoom I anticipate being left to encounter difficulties and embarassments in being cast upon the world without my guardian care and protection which my adult children have received and enjoyed and which latter have by me heretofore been advanced as far as I can conceive it my duty from my means to contribute to them. I hereby appoint my said wife Jane Gillespie and my son James Gillespie my executors and desire that they shall take upon themselves the execution of my said will and the security for the excution of said trust shall not be required of them. In witness whereof I hereby declare and publish this foregoing as my last will and testament hereby revoking all others and former wills and testaments by me at any time heretofore made this 6th April, 1839.
