GAYLER (sic) Filed June 30, 1908 FILE IS STAMPED- REJECTED SOLDIER'S APPLICATION FOR PENSION I, James Gaylor a native of the State of Tennessee and now a citizen of Tennessee, resident at Cupp in the County of Campbell in said State of Tennessee, and who was a soldier from the State of Alabama in the war between the United States and the Confederate States, do hereby apply for aid under the Act of the General Assembly of Tennessee, entitled "An Act for the benefit of indigent and disabled soldiers of the late war between the States, and to fix the fees of attorneys or agents for procuring such pension, and fixing a penalty for the violation of the same." And I do solemnly swear that I was a member of the 5th Battalion, Alabama Cavalry in the service of the Confederate or United States, and that by reason of disability and indigence I am now entitled to receive the benefit of this Act. I further swear that I do not hold any National, State, or County office, nor do I receive aid or pension from any other State, or from the United States, and that I am not an inmate of any soldier's home, and that I am unable to earn a reasonable support for myself and family. ARE YOU MARRIED, OR HAVE YOU BEEN MARRIED? Answer: Yes, but wife is dead. IF SO,WHAT IS THE SIZE OF YOUR FAMILY LIVING TOGETHER? Answer: I am without a home - my family is scattered. WHAT ARE THE RESPECTIVE AGES OF YOUR WIFE AND CHILDREN LIVING WITH YOU: Answer: Wife is dead and children all gone from me for many years. TO WHAT SEX DO YOUR CHILDREN BELONG? Answer: 3 girls and 3 boys. ARE NOT SOME OF YHOUR CHILDREN ABLE TOSUPPORT YOU? Answer: No and support themselves. IN WHAT BUSINESS ARE YOU NOW ENGAGED, IF ANY, AND WHAT DO YOU EARN? Answer: I am not able to work,and do not, don't earn anything. I just live around among the people. WHAT ESTATE HAVE YOU IN YOUR OWN RIGHT, REAL AND PERSONAL, AND WHAT IS ITS VALUE? Answer: None WHAT ESTATE HAS YOUR WIFE IN HER OWN RIGHT, REAL AND PERSONAL, AND WHAT IS ITS VALUE? Answer: None HOW HAVE YOU DERIVED SUPPORT FOR YOURSELF AND FAMILY FOR THE PAST FIVE YEARS? Answer: From just living with people and sometimes with some of my children. DO YOU USE INTOXICANTS TO ANY EXTENT? Answer: No HOW LONG HAVE YOU BEEN AN ACUTAL RESIDENT OF THE STATE OF TENNESSEE? Answer: Always, until about 1858- I went to Alabama, and in 1868 I came back to Tennessee and have lived here until now. HAVE YOU AN ATTORNEY TO LOOK AFTER THIS APPLICATION? Letter: 1400733 War Department The Adjutant General's Office Washington, D.C. July 13, 1908 Respectfully returned to the President Tennessee Board of Pension Examiners Nashville. The name of James Gaylor has not been found on the rolls, on file in this office, of the 5th Battalion, Alabama Cavalry, Confederate States Army, nor has any record been found of the capture or parole of a man of that name and organization. The records show, however, that one J. B. Gaylor was a corporal of Company H, 5th Alabama Cavalry, Confederate States Army. His name appears on the muster-in roll of the company dated at Cherokee, Alabama, November 1, 1862, the only roll on file, which shows that he was enrolled September 9, 1862 in Marion County, for the war. W. Agee, Dept. of C---- (?) Master Chancery Court of said County, the above named Dr. W. B. Powers, one of the subscribing witnesses to the foregoing application, and who is a physician of good standing, and being duly sworn says that he has carefully and thoroughly examined James Gaylor, the applicant, and finds him laboring under the following disabilities: Disease of the stomach and resulting disease of heart -Has shortness of breath -pulse is irregular and very hard. Soreness (?) and touchiness (?) on pressure over stomach. Can eat nothing scarsely with out inconvenience. Has lost almost all of his flesh - is nothing but a reck(?) physically. Complains of feet and legs swelling during the day. He is totally disabled from the performance of manual Labor. Witness my hand and seal of office this 29 day of June 1908 (Signed) J. W. Clerk Master Chancery Court, of said County, the above named Sylvester Cooper, aged 82 years and John Myers, aged 79 years, two of the subscribing witnesses to the foregoing application, with whom I am personally acquainted, and known to me to be citizens of veracity and standing in this community, and who make oath that they are personally acquainted with the foregoing applicant, and that the facts set forth and statements made in this application are correct and true, to the best of their knowledge and belief, and that they have no interest in this claim, and that said applicant's habits are good and free from dishonor. And _______ blank_______ further make oath to the following facts touching the applicant's service in the __blank_________ army: State here what witnesses know of their own knowledge. Our statement is made from our long and personal acquaintance with claimant, but we have no personal knowledge of his service in the army, but we believe his statements are worthy of full faith and credit and his appearance and our acquaintance indicate that such is a fact, though we know nothing of his army service personally.
