CANNON COUNTY, TN - DEEDS - Ward and wife Elizabeth Preston Barratt to Thomas Preston, 3 Nov 1854 ----¤¤¤---- Cannon County Deeds, November 3, 1854, Cannon County, Tennessee; Whereas, John Preston late of Cannon County State of Tennessee, died seized and possessed of a certain tract of land lying and being in Cannon County District No 6th, State of Tennessee, and bounded as follows to wit, on the North by the Lands of Elijah or James Neely on the East by the lands of John Higgins on the South by the lands of A. N. Johnson and on the West Tittle & Preston, containing about one hundred and fifty acres And being the tract of land that said John Preston purchased of William Preston the deed to which is duly registered in Cannon County Tennessee which is here referred to for the precise mites and Bounds and being the same Tract of Land upon the said John Preston Resided at the time of his death, and whereas the said John Preston deceased, left as his only children and heirs at law. Thomas Preston, William Preston, Samuel Preston, James Preston, Elizabeth, wife of Ward Barratt, Sally wife of Tilford Walls, Rebecca J. Preston to whom the above described tract of land descended as heirs the said John Preston, having died intestate & without any will and having the above tract of land and a small amount of personal estates as his only property for distribution. Now therefore, we Ward Barratt and his Wife Elizabeth formerly Elizabeth Preston, have this day bargained and sold and do hereby transfer and convey to Thomas Preston and to his heirs and assigns forever, for the consideration of sixty dollars to us in hand paid, the Receipt whereof is hereby acknowledged. All our right Title interest and claim both legal & equitable present and expectant into and to the before described track of land and also in and to the personal estate, of the said John Preston deceased the same being our entire interest and claim yet undivided, in and to both the real and personal estate of the said John Preston deceased and which we hereby convey to the said Thomas Preston to have and to hold to the said Thomas Preston and to his heirs and assigns forever. We do covenant and bind ourselves heirs and Representative to warrant the title to our undivided interest in said Tract of Land and personal estate of the Estate of said John Preston, deceased and our interest being one seventh part of the same to the said Thomas Preston & to his heirs and assigns and to defend the same against the lawful claimes of all persons whatever. Wilsher State of Tennessee/Cannon County: Pesonally appeared before me Brinkley Lasiter, Clerk of the County Court of said Cannon County, the within named Ward Barratt one of the bargainers with whome I am acquainted and who acknowledged that he executed the foregoing deed on the day it being dated and for the purpose therein contained. Also personally appeared before me Elizabeth Barrattt, the other bargainer and feme covet to the foregoing deed, privately and apart from her husband the said Ward Barratt, and acknowledged that she executed the foregoing deed of conveyance on the day it bears date, without compulsion, ?????, or restraint from her said husband and for the purposes therein contained.
