CANNON COUNTY, TN - WILLS - Estate Paper of David Hollis ----¤¤¤---- Cannon Co, TN County Court Minutes Book “C”, pages 178 & 179 State of Tennessee October Term of the County Court 1852 Cannon County The Petition of Joseph Hollis, administrator of David Hollis, Deceased John Hollis, Abraham L Hollis, David Hollis, Jr, Simeon Hollis, William J Walkup and his wife Mary Ann Walkup, formerly Mary Ann Hollis, Lewis Bond and his wife Elizabeth Bond, formerly Elizabeth Hollis, Luke Lasiter, and his wife Lucinda Lasiter, formerly Lucinda Hollis, David J Ara and his wife Mary Ann Ara formerly Mary Ann Hollis. The two last mentioned Petitioners (to wit) Lucinda Lasiter, and Mary Ann Ara are daughter and heirs at law, of James B Hollis, deceased, and granddaughters of said David Hollis; Joseph L Hollis, James W Hollis, Ann Elizabeth Hollis and Malvina Hollis are minors and heirs at law of James B Hollis, deceased, and grandchildren of the said David Hollis, deceased who have no Regular Guardian, all of whom petitioners & defendants are heirs at law and distributes of David Hollis deceased. Your petitioners would respectfully state and show unto your worships that David Hollis departed this life in the month of June 1852 Intestate and that your petitioner Joseph Hollis was appointed by the worshipful county Court as his administrator and that he entered into bond and security as the Law directs and has also entered in & upon said Administration. You petitioner would further state, that all nearly all the Personal property have been Exhausted that came into the hands of said Administrator Joseph Hollis, in the payment of the debts of the said decedent, and that there still Remains an outstanding indebtedness against said Estate of an hundred dollars with interest for six years--which it is now unpaid and that there is no way of paying the same arising from the sale of the Personal property, the said debt is due to said David Hollis, Jr. Your petitioners would further state and show unto your worships that said David Hollis aforesaid, died seized and possessed of a certain Tract or parcel of Land lying and being in Cannon County, Tennessee in Dist 3 on Brawley’s fork of Stones River, and Banded as follows, to wit, Beginning and John Mc__ south west Corner, on a Buckeye, Bearing south 134 poles to a Shelby Bark Hickory, thence East 180 poles to a Cedar sapling, thence north 134 poles to a stake, thence west 180 poles to the Beginning. Containing by Estimation 150 3/4 acres. Your Petitioners would here state that it is not only necessary to sell the above tract of Land to pay the said outstanding debt. But that it is necessary to sell the said Land for distribution among the Heirs and distributes as said Land is in a condition that it cannot be partitioned and thence it is manifest tothe Interest of the heirs that the said Land should be sold: The premises considered that petitioners prays your worships to Issue Copy and __ and that the minor children of the James B Hollis deceased, named in the coptition of the Petitioner be made defendants thereto and that a Guardian ad litem be appointed for the said Minor heirs, and that he appear at the next term of this court and answer this petition, and on final hearing of this cause, your petitioners prays your worships to order and decree that the said Land above mentioned be sold on such terms as shall be most to the Interest of the above named parties and that so much be paid down as shall pay the above named outstanding indebtedness also pay all the cost of this proceedings. and as is duty Bond will _ pay &c and for further cost Guard ___, &c GB Davis att for petitioners State of Tennessee Personally appeared before me Brinkley Lasiter, Clerk of Cannon County the County Court of said county, Joseph Hollis and made oath that the matter and things stated in the above petition is just and true to the best of his knowledge and belief.
