First I direct that my funeral expenses and all my debts be paid as soon after my death as possible out of any monies that I may die seized and possessed of – or may first come into the hands of my executors. Secondly, I give and bequeath to my beloved wife Mary Lawrence (two tracts of land lying in the count & state aforesaid on the waters of the east fork of Stones River one of the tracts aforesaid being the same on which I now reside containing about one hundred and two acres and the other tract of twenty eight acres lying east of and adjoining said first mentioned tract of land) during her natural life and after her death to Andrew Jackson Phillips and Benjamin Franklin Lawrence my grandsons – and their heirs and assigns forever. Further it is my desire that my wife Mary have all my perishable property for her better maintenance and support during her widow hood and also her natural life provided she marrys not again. But not otherwise, and after which any or all of said personal property that may be remaining, that the same be divided equally between by grand children herein names ( to wit ) Mary Caroline, Henry, Jefferson, and Sally Lawrence ( daughters and sons of my son Jesse Lawrence) and Martha, Mary and Margaret Phillips, daughters of my son in law Samuel Philips and his wife Elizabeth. Thirdly, whereas heretofore I have made provision for my son in law David Barratt and his wife Martha by bestowing many gifts of property to them as also other favors by me to them granted. It is my desire that the said David Barratt and his wife Martha or either of them have no more of my property or any part thereof real or personal. Lastly, I do hereby nominate and appoint my wife Mary and Jesse Lawrence my Executrix and Executor – In witness whereof I do to this my last will and testament set my hand and seal this the 14th day of October 1843.
