Edward Gwin of the County of Carroll and State of Tennessee of the one part, and Benjamin Berry of the state and County aforesaid of the other part Witnesseth, that the said Edward Gwin for and in consideration of the sum of four hundred eighty four dollars to him in hand paid the receipt hereby acknowledged hath this day bargained sold conveyed and con firmed and by these presents doth bargain sell convey and confirm unto the said Benjamin Berry his heirs and assigns forever a certain tract or parcel of land being lying and situ ate in the County of Carroll and bounded as follows by beginning on a stake on the North boundary line of said survey running thence East 193 1/3 poles to black oak & three black oak pointers it being the corner of said survey thence South 142 poles to a stake thence West with Latimer's line to his N.W. corner 75 1/3 poles thence South 45 degrees W. with the west boundary line of a small tract of land sold & conveyed by the said Gwin to Berry to S.West corner thence west to the S.E. corner of a tract in the name of James Rogers thence North 167 poles to the beginning. Also one other small tract beginning at the S.E. Corner of said survey on a black oak running West five poles thence North one hun-dred and fifteen poles to a stake thence East five poles to a stake on the East boundary line of the survey thence South to the beginning both containing two hundred and forty-four acres and one hundred and one poles be the same more or less the title to the premises aforesaid with all and singular to hereditaments in and to the same belonging to have & to hold to the said bargainer Berry his heirs and assigns forever and the said Edward Gwin for himself his heirs executors and administrators covenant and agree to and with the said Benjamin Berry his heirs and assigns the title to the premises aforesaid against himself his heirs Executor & assigns and all persons claiming by the right from or under him to warrant and forever defend. In witness whereof he the said Edward Gwin hereunto set his hand and seal the day & date above written.
