Dougherty Bk D, Pg. 269 Grantee: Edward Gwin Date: 14 Aug 1838 Land: 12th Dist, Rng 2, Sec 2 This Indenture made and entered into this 14th day of August A.D. 1838 by and between Robert E.C. Dougherty of the one part, and Edward Gwin of the County of Car-roll of the other part Witnesseth, that said Robert E. C. Dougherty for and in consi= deration of the sum of ten dollars to him in hand paid the receipt whereof is here by acknowledged, and for the considerations hereinafter mentioned has given granted, bargained and sold, and by these presents, does give grant, bargain, sell alien and convey to Edward Gwin the following described tract and parcel of land (to wit) situate and being in the 12th surveyors District in West Tennessee in second Range and second section on the line dividing the Counties of Weakley and Henry and bounded as follows (to wit) Begining at the south west corner of Entry No 932 in the name of George Dougherty, run thence north Two hun dred and forty poles to a stake and hickory and maple pointers. Thence East three hundred and twenty poles to a stake and red Oak and two post oak pointers in the Barrens. Thence South two hundred and forty poles to a stake standing in the North boundary of Entry No. 1542 in the name of John Porter. Thence West three Hundred and twenty poles to the begining, entered in the name of Wilson Cage by Entry No. 2120 and containing by estimation four hun= dred and eighty acres. To have and to hold the aforesaid tract of land with its tenements and hereditainments to the said Edward Gwin his heirs and assigns forever and the title to the aforesaid tract of land, tenements and hereditaments, the said Robert E.C. Dougherty for himself, his heirs and assigns shall and will warrant and forever defend to the said Edward Gwin his heirs and assigns against the lawful claim or title of all and every person or persons whatsoever. But this conveyance is subject to the following Trusts and pur purposes to wit, Whereas the said Edward Gwin is security of said Dougherty in a bond executed to Daniel Dillon whereby said Dougherty and said Gwin as his security have bound and obligated themselves to convey and trans fer to said Dillon a tract of land of the quality and value in said Bond stated and for the considerations therein stated which bond is in the hands of Shadrach Flewellen Agent of said Dillon for the purpose of receiving a deed for and in conformity thereto. And the said Dougherty being solicitor to secure and indemnify said Gwin against any injury or losses which he might sustain by being security as aforesaid. Now if said Dougherty shall fully pay off and discharge said bond or comply with the terms thereof with-out said Gwin incuring any loss or injury by reason of being security therein, the the foregonig conveyance is to be null and void, but if said Gwin shall be compelled to pay off and discharge said Bond to said Dillon, or shall volunta rily do the same, or pay off and discharge any part thereof, then and in that case the foregoing conveyance shall be and remain in full force and virtue for the purpose of indemnifying said Gwin as aforesaid, and said Gwinshall have power and authority to sell and convey said land or any part thereof that may be necessary to pay off and discharge said bond, either at public or private sale as may be most to the interest of said Dougherty, and the rest and residue of said land or the proceeds thereof after paying and dis= charging said bond shall be and remain to the proper use and benefit of said Dougherty, said Gwin agreeing to convey or deliver over such balance of said land or proceeds thereof as may remain in his hands if any after having accomplished the purpose aforesaid by paying off and discharging said Bond.
