To have and to hold to him the said MCDONALD forever and I do further covenant with the said MCDONALD that I have a good right to the said Slaves and that the same are unencumbered and Slaves for life and are sound both in body and mind. But this Bill of Sale is made for the following use and trust and for no other purpose that is to say I am indebted to John W. ROGERS, of the county of Dyer and State of Tennessee by two Several? notes in the Sum of five hundred Eighty five dollars. One note of three hundred and seventy four dollars bearing date 21st January 1842, and due one day after date and the other for two hundred and eleven dollars bearing date the 19th May 1842 and due on day after date and the said John W. ROGERS is willing to indulge me Six Months longer and being desirous to secure the said ROGERS have made this deed to said MCDONALD now if I should pay the said debt at the time aforesaid then this Bill of sale to be void, But if I should not then the said John MCDONALD as trustee after giving twenty days notice in writing at the Court house door in the Town of Huntingdon and two other public places in said County may expose the said Negroes to public sale for cash and appropriated the proceeds first to the payment of the necessary expenses and cost. Secondly to the satisfaction of said debt and thirdly to pay the balance if any there be to me. In Witness whereof I have hereunto set my hand and affixed my seal this 21st day of May 1842. ALLEN, Clerk of the County Court of said County , John DAUGHTERLY and John T. ROCHELLE and after being sworn say this that they are personally acquainted with Cynthia ROCHEL and that she acknowledged that she signed the within Deed of Trust for the purposes therein set forth and on the day it bears date.
