This indenture made and entered into between Phebe Scates of the first part and

David McDonald of the other both of the State of Tennessee and County of Carroll

witnesseth that for and in consideration of the Sum of Three Hundred and fifty

Dollars to me in hand paid the Receipt and payment whereof is hereby acknowleged

hath this day bargained and Sold and by these presents doth bargain Sell and

Convey to David McDonald aforesaid a certain lot or parcel of land in the Town

of Christmasville Known as the plan of the Town as Lot No. Two being the Lot

Conveyed to A N Scates by John C. McLemore & the Lot including the Tanyard

formerly occupied by The sd. A. N. Scates with the privilege of Conveying water

from the Spring for the use of said Tanyard and all other privileges and

appertenances in any wise pertaining to or in any wise belonging to Said Lot or

tan yard and also a slip or parcel of Land Conveyed to the aforesaid Phebe

Scates by George W. Hite along the South Side of Said Lot No. Two or tan yard.

Bounded thus Begining on the South west Corner of Lot No. 2 Thence South to a

stake thence East to a stake at or near the fence about five poles five feet & 9

inches from the Stake the South west Corner of sd. Slip thence [N] back to the

fallings of said yard thence East three poles nine feet & eleven inches to a

Stake and paralel with the East line of said Lot No. Two as fallings an the East

side sd. yard thence north to the thence North to the South line of Said Lot

then with said line back to the begining to the proper use and behoof of him the

said David McDonald his Heirs assigns Executors or administrators forever and I

the aforesaid Phebe Scates doth hereby further covenant and agree with him the

Said David McDonald that I am Lawfully seized of Said Lot Yard or parcel of Land

have a good right to Convey the Same and that it is unincumbered in any way and

binds my self my Heirs Executors Administrators & C. to warrent and forever

defend the title to Said Lot or yard & parcel of land to the aforesaid David

McDonald his Heirs or assigns against the lawful Claims of all persons what ever

in witness whereof I hereunto set y hand and affix my Seal this 17th day of

October 1854.

Personally appeared before me Willson H. Graves Clerk of the County Court of

said County Wm. M. Guinn & J. E. Scates witnesses Subscriber who being duely

sworn depose any say they are well acquainted with Phebe Scates who acknowledged

that she Signed the foregoing Deed for the purposes therein contained and on the

day it bears date witness my hand at office this August 28, 1856.
